Question

I just looked at ebenefits this morning, nothing new.  I just checked again . It says judge has made decision and we should be getting letter soon.  This day marks the fiftyth anniversary of my husband leaving Vietnam!

Called Vso, he was on the phone.  But his receptionist said the decision was made today.  If so I guess ebenefits is up to date.  No new benefit letter.  Does that mean they denied?  But it had date on letter still in dec 17.  Oh crap I’m nerves!

It' going to take a week or two for the judge to write up the decision. Mine was decided 19th of April and i didnt find out the decision until the 3rd of May. Nobody will tell you the decision over the phone. Just be patient. Vets.gov let me know the decision a coie of days before i received the letter.

No.  If your VSO gets notice of a decision, and ebenefits does not reflect an increase this does NOT mean you are denied.  

1.  Ebenefits could be wrong, or out of date.  VA updates ebenefits willy nilly, when and if they want to.  

2.  Your VSO "might" be able to tell you, but he may choose to not let you know until you get the letter.  

3.  Involve yourself with something you like to do:  Go fishing, go see grandkids, etc.  There isnt anything you can do to hurry it up, except maybe make sure your bank deposit information is current and up to date.  Someone said "A watched pot never boils".  So dont watch for your mailman.

Still no VA Lawyer? At 70+, the clock is not his friend.

You may have already posted his BVA Docket Number, or not. It would help get a better handle on his remand situation.

I doubt there is anything you can do at this point, other than attend any Remand C & Ps that you are notified about.

Hindsight, Monday Quarterbacking, as I recall AskNod wrote about not letting your BVA Appeal go back to the RO for another crack at Denying you again. In your case, that boat has sailed. Find a VA Lawyer for a set down, just to see what they might be able to do. You have nothing to lose, but time and maybe 20% of a possible Retro Award. If you get another Denial, you're heading to the CAVC. If a VA Lawyer isn't interested, you're SOL and have to finish the ride with your VSO.
