Appeal Aid and Attendance

Question

It has now been 12 years since I filed for a higher level of aid and attendance, been to multiple C&P exams and had my appeal sent back to the original RO for a bevy of reasons but I just can't seem to get an answer from them.  They have since bought me a new vehicle and did a

home improvement for my disabilities but still now answer on my higher level of AA.  How should I best approach this.  I am really limited physically in what I can do, I need the services to attendants to come in everyday to help me, I get no response for that, I mean should I just do

the major check out and call it quits.  This is killing me literally and I don't know what to do.

Ok, so you did not get a VARO decision on Aid and Attendance in 12 years???  Contact the white house.  This is crazy even for a crazy VA.  Explain 38 CFR 3.103 requires you be given a written decision but none for 12 years. 

Its possible, or even likely, you did get a decsion, but one was never mailed to you.  Are you sure VA has your current and correct address?  Update that, and after you are sure its right raise heck with the president on the hotline.

12 years, DIY or POA-VSO assisted filing? Who's been doing the followup? Any Claims postings and VA Decision Letters that you could redact and post?

The work done on your home, was it the result of the HISA Grant administered thru your VMC Prosthetics Dept? Have you or your Rep been able to determine who drooped the Ball?

Are you using a family member or private Company for in-home care, makes a difference?

I agree with Hollie Green. Many, many Vets have won benefits and posted their win.  

Back in 2003, my VSO (VFW) dropped me because they  did not think my claim would fly.  

I continued, anyway.  Later, I  found out I had all the Caluza elements when the VFW said it would not fly.  

Then, after my BVA appeal was granted, I had at least one VA employee tell me that an appeal was a waste of my time.  (The BVA awarded me, then the VARO decided to award 0 percent. )  

Repeatedly, I have been told I dont have a case.  

In 2009, I was awarded 100 percent back to 2006.  I have appealed the effective date, and its now back to 2004.  

Im still not giving up, the VA still owes me 2 more years of retro, and I will hang in there until I get it.  Currently Im represented by an attorney.  Remember, attorney who agree to represent you, put out their money and time...and they dont do that unless they think they will get paid, that is, that I will get retro.  

Never give up.

Listen to everyone here, contact the White House and demand answers. Dont give up! I contacted the secretary "Bob" when he was in and got the rating I deserved. If I had given up and followed the directions of my Incompetent VSO I would be sitting with a rating far less where I am now.

70% loss of use of right arm due to multiple sclerosis

100% suprapubic cystostomy due to multiple sclerosis

100% loss of use of both lower extremities due to multiple sclerosis

30% left upper extremity weakness

30% insomnia with hypersomnolence

10% neurogenic bowel

NO, please do not do the major check out and call it quits.  That is never, ever the answer.

Call the WH hotline...that is the answer.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
