CRDP-FERS DISABILITY

I DON'T KNOW IF ANYONE CAN ANSWER THIS QUESTION - THIS IS THE SITUATION:

FACTORS THAT I AM:

- RATED AT 90% FOR VA DISABILITY BUT PAID AT 100% AND AM TDIU 

- A CHAPTER 61 MEDICAL RETIREE RATED AT 30% WITH 20 YEARS OF COMBINED SERVICE (13 1/2 ACTIVE/7 NATIONAL GUARD/RESERVES) AND CURRENTLY AGE 59

- RETIRED FROM THE FEDERAL GOVERNMENT ON A DISABILITY WITH 25 YEARS OF SERVICE BUT WITH 13 1/2 OF THOSE YEARS THROUGH A MILITARY "BUY-BACK"

NOW I AM GETTING READY TO RECEIVE MY RESERVE RETIREMENT PAY AT AGE 60 (I THOUGHT) AND I CALLED THE AFPC AND THEY SAID THEY THINK I MAY HAVE BEEN ENTITLED TO CRDP WHICH I THINK WOULD MEAN SOME SORT OF BACKPAY?  BUT IF THAT IS THE CASE, I READ THAT OPM OFFSETS MILITARY RETIREMENT SO I DON'T KNOW WHAT WILL HAPPEN THERE GIVEN THE ABOVE FACTORS.  I NEED TO CALL OPM AND FIGURE IT OUT I SUPPOSE BUT IF ANYONE HAS AN ANSWER TO WHAT WILL HAPPEN BETWEEN MY FEDERAL DISABILITY RETIREMENT AND THE CRDP PLEASE HELP.  THANK YOU.

Thank you for those LONG 7years of service , in the Military and also in the fed gov---

I googled 'OPM offsets to Military Retirment and VA compensation' and a lot popped up but I am hoping someone here ( we have members who are retirees and getting CRSC or CRDP )will chime in.

My daughter did that and just got her 20 year Pin- 7 Years Mil- 13 years DOD-

I dont think we ever got your  exact question here-

wat I dont see here- is SSDI-

My neighbor, 20 years USAF for FERS  (worked for local VA)but he also had to get SSDI as well, when he applied for FERS -which is now regular SSA retirement.

His VA comp is still only 10%- has been for almost 20 years and the other day he again mentioned it should be higher (I have been telling him that for all of the past 20 years) - but I cant seem to get him to go back to his POA rep at the VAMC.

It seemed he had to apply for SSDI when he applied for FERS disability.1997- maybe those laws have changed-

hopefully someone here will know-

You certainly might be eligible for CRDP_ I dont see why not- 

Do you get SSDI too for the same SC TDIU?

I just realized that my neighbor kept saying he was on FERS retirement but I think he meant Civil Service retirement-he worked Part time for VA for a few years and then returned to VA for a full time job for only a few years.

Others will help-we have retirees here-

I am retired Reserves - (USN 1975-1997)  8 Active Duty - 14 Reserves - Just started my Tricare and pay. There will be an audit to your account -

Reserved center letter I received is they are  12 MONTHS........... Behind on the pay...

You will get the retro for retirement.

The Audit takes about 4 months so if any retro for CDRP is awarded it will be included, but call anyway. 

1.Call the retirement personnel office for your particular service by googling it. 

2. Take names and dates et al - I did have to call more than once.

                           I received my RETIRED ID card - which triggered my Medicare Part B- 🙂  Tricare....

                  it is free BUT you still are charged the $122 out of your SSDI if your are receiving it, so in essence not really free but a big benefit! -

                  Tricare is really taking good care of me. 

3. 2004 initiated CONCURRENT,  pay where you can collect BOTH retirement and disability.  Some of the retro pay talk comes down to those who were involved during the....... initial - pre time frame.  COMBAT pay is what you are asking about with the CDRP. 

Your pay calculations  for retirement are based on RANK at retirement, and BASE PAY for that RANK in today's scale. 

I bugged the guys in personnel to death. 🙂

I did not believe I should have to wait 12 months for my retired pay since the CRITERIA to apply............. is 12 months ahead

BTW - you will need a NEW ID card.

The blue ID card for the IU - award is different......

                                              YOU NEED A RETIRED BLUE ID - for health care et al. RETIRED  member benefits.

I had to apply for SSDI to receive FERS, My OPM is offset with the SSDI not my military retirement. The requirement is that you have to apply to SS but you don't need to get approved.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
