Records missing in C-File

What can be done if Records are missing in  your C-file

I was looking through my C-FILE last night (its on C.D.) and is easy to navigate through on my lap-top

Anyway there are some records missing and some that looks like it never copied over  just a blur..and a whole bunch of blanks sheets?

I have some records that is not in my C-File  like parts of my Award letters, and some are very important, Thank GOD I have one that is very important  that is not in my C-file.

so where did that record go? How in the heck do they loose these records?

I am lucky I have that record  and I realize I could send it to those idiots to put back in my C-FILE but  why do that  they could lose some more when they go to put this one back in.   eh! ...>  the damn idiot's,  they probably don't know the difference between there ass and hole in the ground   damn  idiot's

They don't have people hand scanning all of that, no different than a hospital or any other large enterprise. They have a machine bulk scanner that does it at several hundred pages at a time, and sometimes things dont get scanned. Yes, it sucks that there are things missing from  your records, and others', but if the VA paid people to hand scan everything they wouldnt have money for doing other things that they are supposed to do, and it would take even longer to do it by hand, even if they used volunteers. 

 

If you want stuff added to your records just take them into the information security office at your local medical and they can put them back into your records.

(I AM NOT A RATER- I work the claims BEFORE they are rated, annotating medical evidence in your records, VA and Legal documents,  and DA/DD forms- basically a paralegal/vso/etc except that I also evaluate your records based on Caluza and try to justify and schedule the exams that you go to based on whether or not your records have enough in them to warrant those)

Buck, regardless of the content of the missing C-File Documents, there's no Good reason to poke the Hornet's Nest.

You have no New or Increase Claims in the works, you're IU T & P No Future Exams. I don't recall if you have SMC S or not, but barring an "S" Claim, I see no reason to send anything into the Rating Dept other than the IU Anniversary Date 21-4140 yearly Filing.

Missing records in your cfile is a huge problem.  This has essentially created massive, massive delays in my benefits.  

If those records missing are significant, and if you are seeking an increase or new compensation, then by all means make a copy of your records and send it in to the evidence intake center.  

However, I agree with GAstone.  Unless you are seeking additional benefits and the missing records are related to that, then dont poke a sleeping bear.  If you need that evidence for additional compensation, then by all means send it in.  

In other words, "poke the bear" only if there is a compelling reason, otherwise, leave him sleep.  Making sure your cfile is complete is not a compelling reason to wake up the bear.  Getting additional benefits (including one or more SMC's) is a good reason to poke that bear.

Oh Yeah Gastone  I will just keep what records they don't have  if I ever need it I will have it.

I was just scanning through my C-File checking my Effective dates and if any dairy dates.

 

At my DRO Hearing I was awarded the tinnitus  10% and the TDIU P&T the day of my Hearing  they expedited that day,

However the tinnitus says effective date Feb 2002...and the IU /with P&T Says the Effective date is March 2003..so they must have changed these dates...because my Hearing date was May 7th 8:45 am 2003  lasted 1 hour and 20 minutes

so go figure?

The DRO  Mention that although we paid you back to 1999 the date you first filed for increase not the original filing date of 1998

I believe they have these dates screwed up..I was awarded them both on the same day   they just changed the dates for some reason or another?

Anyway yeah I'll let the old  sleeping dog lay.

  I am not sending them the records I do have &  or the ones they don't have...they created them and they should have them  if they lost some that may help me later and I have them..I'll use them as evidence if need be.  most of the ones I seen had a post dated time/date stamp. stamped on them.

I always had the DAV Rep or Voc -Rhab counselors  date stamp everything I sent the VA.while I was working my claims

I just wish I knew what records were missing? & the ones that  I can't make heads or tails out of them...  there either to blurry to read or have chicken scratch all over it  little dots like a million of them all over the page.

I had a lot of school registry apps & school schedules pages in my C-File...I started  to college back in Jan 1974 finished in June `1977  changing my major 2 times going full time or 12 semester hours each session. it was tough!!

The VA paid me for going full time at night  I worked during the day 7:00am to 4:00 pm go home clean up and head out to school ,  Hey not bragging or anything but  I did get on the Deans Honor Roll/ List  with a grade point average 3.5...but I own that to my spouse for typing up all those essays and short stories....probably the only good thing I did during my life  other than marrying the most beautiful woman of my life we married  Sept 22nd 1973..  this Sept will be 45 years.

 I have  boo coos of school records...for a criminal justice associates degree  Had to stop going to class rooms due to my bad hearing...I kept on going and just made it the best I could until the Mid 90's and this is when I filed my first claim  back in 1998..

so my C FILE consist of my DD 214 And the earliest date in my C=file was when I applied for school  bck in 1974 plus what claim records are in it medical records  ect,,ect,,,

I may request my C-File again and see if it has any more records in it Than what this C-file has??

I did notice my dairy date for 2/ 2017 was canceled. No dairy dates scheduled.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
