AMC holding my retropay hostage

I filed for TDIU back in july of 2014 and was denied I went through the entire Appeals process and was granted TDIU

I also have on the appeal a REMAND for Special monthly compensation. The SMC stems from the VA doing botched eye surgery on me which has now effected my life forever (for the worst)

The BVA has since sent both issues to the AMC. TDIU was granted SMC is on remand.  

TDIU was granted this year July 12th. I have already received my packet and the SMC remand has already received a C&P exam and given me a docket number in the 50k range

The AMC has no call center and isn't under the jurisdiction of the BVA or pretty much anybody.

It has been 12 days and I have received no retro pay they haven't updated anything in my records stating I have been granted the TDIU 

 

I have called the Trump hotline multiple times. I have contacted the BVA (don't bother), the RO (nope) and my VSO (trying to be helpful?).

 

Basically from what ive ascertained from the 1000 number and the trump hotline is that the remand is holding my granted item hostage

I could be looking at anywhere from 7-17 months for my remand to be finished. What I find most peculiar is that apparently they cannot pay my backpay on my GRANTED TDIU until my REMANDED SMC is finished.

 

What is going on here?

Who knows about this stuff?

Why are they holding my backpay hostage?

Why was the call center to the AMC dissolved?

How is it possible for the AMC to hold my backpay hostage on a granted item due to a separate item being on remand

im incredibly perplexed and honestly really pissed that I could be waiting a year and a half for backpay on something that was already granted

Probably the funniest detail I got from the Trump Hotline and my VSO is this

"You could get paid tomorrow or up to 17 months when your remand should be finished. So check your bank account everyday"

Checking my bank account everyday expecting the lottery for 17 months is a surefire way to turn anyone into a crazy person.

They can/should "dole out the tdiu" and work the remands later.  There was a fast letter where VA's were expected to do just that.  Its called a "partial grant", and, yes they should send your money.  However, getting VA to follow their rules is another problem.  If you look under "fast letters"  and "partial grants" you may be able to find that fast letter and hold them to it.  But, I dont recommend stiring up a hornets nest until "at least" a month, as that is very fast.  Better to wait 6 weeks or two months.   It would be like yelling at your waitress if she didnt have your food out in 30 seconds.   Its another issue if they dont have your food out in 40 minutes, tho. 

     My advice is to wait at least 30 days.  Then, if still no money after 6 weeks, send an IRIS email, but be nice.  

     "I just wanted to check on the status of the TDIU grant which was awarded 6 weeks ago.  Isnt it true that (look up fast letter) requires you not delay this partial grant, and implement it immediately?

       Just like your waitress, "attacking" her when the meal is not out in 30 seconds is a bad idea. 

        Instead, when you order, "Say, I have to be somewhere in 20 minutes,  Is it possible to rush this order and bring my check right away?  My tip will reflect your degree of cooperation on this."  

       With VA, you need to rely on their desire to help Vets, and unfortunately not all employees have this.  Say something like, 

"Is there any way to fast track the implementation of the TDIU?  Im in a financial hardship right now (list the hardship).  Thank you.

The BVA has since sent both issues to the AMC. TDIU was granted SMC is on remand.  

This would be a separate claim with the botch up eye surgery.

SMC is an inferred claim  so your IU retro should come soon  check your Bank Account daily.

I agree with broncovet since you been granted the IU THERES NO REASON FOR THEM TO HOLD UP YOUR RETRO   IF ITS A LARGE AMOUNT IT TAKES LONGER FOR THEM TO RELEASE THE FUNDS IT NEEDS 3 SIGNATURES, THE LAST ONE IS WHAT HOLDS IT UP.

THE PERSON THAT NEEDS TO SIGN IT COULD BE ON VACATION OR ON SICK LEAVE...DIFFERENT REASONS FOR THE DELAY.

Wasn't the IU Award remanded to your RO to have the Rating staged? The difference between your actual CSC Comp (70 to 90%) Level and the IU 100% varied year to year while awaiting the BVA Award.  Any Retro Comp Award amount over about $25K has to be signed off on by the MFIC of the VA DC Award Dept. Adds significant time to the Retro Disbursement.

You do have your Direct Deposit Account set to real-time TxT and Email you regarding ALL Financial transactions, don't you?

Your Direct Deposit accounts set up for real-time txt and email?

IU Retro North of $25K can result in a delay getting the Second signature from DC.
