AMC holding my retropay hostage

I filed for TDIU back in july of 2014 and was denied I went through the entire Appeals process and was granted TDIU

I also have on the appeal a REMAND for Special monthly compensation. The SMC stems from the VA doing botched eye surgery on me which has now effected my life forever (for the worst)

The BVA has since sent both issues to the AMC. TDIU was granted SMC is on remand.  

TDIU was granted this year July 12th. I have already received my packet and the SMC remand has already received a C&P exam and given me a docket number in the 50k range

The AMC has no call center and isn't under the jurisdiction of the BVA or pretty much anybody.

It has been 12 days and I have received no retro pay they haven't updated anything in my records stating I have been granted the TDIU 

 

I have called the Trump hotline multiple times. I have contacted the BVA (don't bother), the RO (nope) and my VSO (trying to be helpful?).

 

Basically from what ive ascertained from the 1000 number and the trump hotline is that the remand is holding my granted item hostage

I could be looking at anywhere from 7-17 months for my remand to be finished. What I find most peculiar is that apparently they cannot pay my backpay on my GRANTED TDIU until my REMANDED SMC is finished.

 

What is going on here?

Who knows about this stuff?

Why are they holding my backpay hostage?

Why was the call center to the AMC dissolved?

How is it possible for the AMC to hold my backpay hostage on a granted item due to a separate item being on remand

im incredibly perplexed and honestly really pissed that I could be waiting a year and a half for backpay on something that was already granted

L, the Rating Dept obtaining the DC Rating Dept Honcho's authorization signature regarding Retro above the $25K (?) is completed before the actual Award Decision Notification takes place.  How was your referenced 12/16/?? Decision Notification presented, Eben, POA-VSO or Award Letter?

Thank you for the fast letter Berta!

I don't think the remand letter will be necessary and heres why.

I applied for hardship using the Trump hotline talking about retropay and my remand.

In the past I was receiving SMC S-1 pay during my many many eye surgeries.

I was curious so I clicked on the benefits page on Ebenefits. 

I then clicked on my old SMC-S-1 tab to see a new effective rating date of 7/23/2018 

Those tabs were from 2015-2016.

 

I called the 1000 number confused and they told me its likely that the AMC is not only working on my retropay for IU but that the new rating date could be indicative of a new favorable rating for SMC S-1 and that everything still hasn't hit the system yet.

I came here confused and worried about retropay for IU and it looks like the Trump hotline rushed my remand as well.

 

If I am wrong in all this I would be so grateful for someone with more knowledge

Gee that is great-

I dont get the dates here however:

the first SMC S thing says "from 9/30/2015 to 11/1/2015", the second says from  2/24/2016 to 4/1/2016, from 4/20/2016   to 6/01/2016-I assume this all involves the eye surgery...?

I dont see anything about TDIU- could it be that the keratoconus is what the TDIU ( 100%) is for?

Maybe the TDIU was "intertwined" with the SMC ratings?

SMC remand is for S-1 which is from the eye surgeries. (they botched them which is why I filed for it)

 

I appealed for TDIU prior to the eye surgeries and that was granted by the judge july 12th of this year.

Those old effective dates are for when I was having eyes surgeries 4 in total. 

I now have to get 2 corneal transplants because they botched it. 

You can only do one corneal transplant at a time each with a 1.5 year recovery time

That's why I filed for SMC which is currently in remand and it appears that with the new rating date it was possibly granted.
