AMC holding my retropay hostage

I filed for TDIU back in july of 2014 and was denied I went through the entire Appeals process and was granted TDIU

I also have on the appeal a REMAND for Special monthly compensation. The SMC stems from the VA doing botched eye surgery on me which has now effected my life forever (for the worst)

The BVA has since sent both issues to the AMC. TDIU was granted SMC is on remand.  

TDIU was granted this year July 12th. I have already received my packet and the SMC remand has already received a C&P exam and given me a docket number in the 50k range

The AMC has no call center and isn't under the jurisdiction of the BVA or pretty much anybody.

It has been 12 days and I have received no retro pay they haven't updated anything in my records stating I have been granted the TDIU 

 

I have called the Trump hotline multiple times. I have contacted the BVA (don't bother), the RO (nope) and my VSO (trying to be helpful?).

 

Basically from what ive ascertained from the 1000 number and the trump hotline is that the remand is holding my granted item hostage

I could be looking at anywhere from 7-17 months for my remand to be finished. What I find most peculiar is that apparently they cannot pay my backpay on my GRANTED TDIU until my REMANDED SMC is finished.

 

What is going on here?

Who knows about this stuff?

Why are they holding my backpay hostage?

Why was the call center to the AMC dissolved?

How is it possible for the AMC to hold my backpay hostage on a granted item due to a separate item being on remand

im incredibly perplexed and honestly really pissed that I could be waiting a year and a half for backpay on something that was already granted

Yes that is what I think too. It all makes sense to me now.

W0W that is a lot to go through-

I had cataract surgery in 2015 and it was easy, painless, and so cool to be awake for the actual cataract removal, and I no longer need to use glasses when I drive.But I am a civilian.

Some years ago BVA had botched multiple caratact operations on veterans.

Ya no cataracts here but I feel for anyone who has to go through eye surgery.

I tell people its like being abducted by aliens

First you get medicated but your awake and you remember everything that happens but once they plop you in the wheelchair to be taken home you forget it all.

Apparently on my 3rd and fourth eye surgery I had become so comfortable with it that I was cracking jokes with the doctors. I don't remember any of this but I hope it wasn't to embarrassing.

 

Well perhaps that rating date is a hint that I needed.

Thank you to everyone who talked to me about this. It is my first appeal and Ill be honest I was becoming impatient with the VA and I apologize for that.

im in a similar situation. i also see a ton new questions on all of had it regarding " after judge makes decision why do we wait for implementation"

this seems that its becoming more and more frequent to delay. Why cant Vets get a direct number to the actual department working on the implementation of the AWARD// like these days when a claim is received we can follow what happens.. 

vets are so put into the dark after the Judge Makes Decision and there no where to go and no one to get a real answer from. 

i fully understand that when the judge creates Down stream issues such as not providing an effective date or not providing a percentage but,,, when the judge grants all 3 parts,, DC # effective Date and percentage this then just becomes a software implementation that all taxpayers paid for the va to have. 

frustration is what the va seems to like to create instead of a job well done.

So, hubby is hitting  that 120 days the last of September.  They have  not even started paying the monthly increase yet.  Has anyone else not getting the monthly increase it.   You ask your Vso and they tell you anything to get rid of you.  No bette4 then Peggy!  Lol

Going to go call amc.  Last time I called them the guy was very rude, saying are you sure your going from 80 to 90%. I’m going to see if I can list them here.

20% for diabetes

10 for histoplasmosis ( happened when active duty)

10 for neouropathy left lower extremity

20 for right lower extremity

60 for cad

10 for hearing 

I think tat is it .  Now the extra 20 for diabetes.

im kinda sure from reading other posts that your award came from a BVA judge. 

have you tried this argument,?

the bva grants me 30 days to ask for a reconsideration and then 190 days for appeal to cvac.

well if the judges decision has yet to be implemented correctly than how does the vet substantial a valid and thorough appeal to cvac without knowing how the judges order is to be interpreted?????

im thinking of trying that argument and i was just wondering if you or anyone has an opinion.
