Check this out, folks. You need to get your claims files and examine them very closely.

Alex , thanks, I have been trying to make that point as well here.

I thought my Nehmer claim error was only a few thousand- not enough for me to consider dealing with them, again-the stress isnt worth it.

But it is over 30 thousand in error-

Nehmer did it right but when it went to my AOJ they prepared an audit FAR off the mark.

This has happened to me many times with this VARO

This is the third audit I have received over the years that is wrong

My new CUE has 3 CUEs in it .On a 2015 decision. The legal evidence is delicious and the CUE was fun to prepare.

I went to the BVA to see if any widows had been denied proper retro un Nehmer2010 and the first claim that popped up was  an award from BVA because that RO had misconstrued  Nehmer.

That is why I posted Nehmer in the AO forum; there is no doubt in my mind that many ROs made errors- not the EED that NVLSP checked but within the decision and retro audit itself.NVLSP was not responsible for any others error- we Nehmerinos were.

In another widow's Nehmer claim  it had been at the CAVC and remanded to the BVA- and NVLSP represented the widow- interesting case.
