Still 40% why?

Question

They closed one of my claims today and ebenefits still says I have 40% but for my disability list says I have 10% for hearing, 10% High Blood Pressure, 20% for Scars and 30% for my left knee replacement as of 08/21/2018, but it's saying I only get 40% the VA rep did the math and I should have at least been awarded 60% so does anyone know why the VA still has me at 40%. I have not received my letter yet explaining why I'm still at 40% rating. I think I found why because when you have a knee replacement scars are covered in the 30% so I think thats why they took the 20% away for scars on my knee. 

Also I called and the VA to ask the question since I had another knee replacement on the same knee I should have been awarded the temp 100% the VA says no you don't get that it's a one time deal no matter how many times you have surgery's on that same knee through the years, so they canceled my total knee replacement claim and told me I could file an appeal but she said don't waste my time on it. so I have no choice but to get another VSO to help me again.

Ebenefits is made up of a number of separate parts, but presented through the single web page. If they just closed the claim today, there is a chance that it might be tomorrow or another day before the inner workings of ebenefits get around to re-calculating your percentage. I am speculating, but maybe when the VARO agent closed the claim, it updated the individual claim status. However, there are likely more steps which follow which can trigger the combined rating to re-calculate.

No brown letter today concerning my case been 6 days. as of Friday the VSO she did not see it in my file she said she would have been able to read it even before I would have received it if it was sent in the mail, but as of today nothing I will give it until Monday then she will call up to the state VSRO and see what going on, because my disabilities rating page say's 60% but that stupid circle that itis above it that says what you have still says 40% so somethings not right. frustrating government system.

Ok I found out I will be only getting 40% the VA took the 20% away from my 60% award for the scars from a old surgery when I had a arthroscopic done on my knee back in 2010 so I was awarded 30% for the knee replacement because in their view my knee made the injury better, so now the VSO said I must file a new claim for the knee replacement for Scars even through I already had the scars in the first place. so as it stands right now I'm still at 40%. The way it is explained to me is like when a veteran loses a hand or arm he gets an award for the injury, but when that veteran get a prosthesis then his award is reduced because it's called Quality of life, the VA made him better so his award would be reduced, and NO the VA does NOT have to notify you if they take an award away they will send you that nice letter to appeal it. I know this sounds stupid but the lady told me on the phone that the VA is making some major changes on how they process their claims. 

This all sounds to familiar with my Malaria claim contracted it on active duty but could not show I was sick, when I went into the reserves is when I was sick and that was the magic bullet that killed my claim and appeal so my disability page says "Malaria Not Service Connected"

 

As for my second total knee replacement I found out I will be getting the 100% temp for the 1 year. I should see something between this September or October for payment funny I had the surgery on June 4th 2018 and they are just now getting around to it.

This is the Golden response that I may be looking for!

 

I currently have a claim and finally a c&p exams set up Nov 20th. I also had a appeal that started 9/2017 and i choose the RAMP on 8/2017. So today 10/31, I see that my appeal has been closed; decision made and letter sent. I see al of this on my EBenefits but my Disability rating remains the same. I figured that they denied my appeal and that is why my rating is the same? I was hoping the rating would change a day later and wanted to ask others here if they have noticed this same issue. Ebenifits updated with closed appeal but rating was the same for a few days, later changed etc. Some help with this , examples etc would be great. After waiting this long and no increase is a real kick in the face. Plus the VA can not or wont tell you anything ..

When I went from 70% to 100%. The first change I saw was on my monthly comp payment. And I was checking E-ben daily.

So did ebenefit show your increased rating right away ? I’m upset stressed because mine closed today but my rating is the same. I called VA and they said my current rating was the same and they would increase it once my thing closed. They said they can’t read the letter or go over result but he sorta answered my question if I was denied my appeal since like he’s saying my rating is still same. Does this make sense? Or would they close out and adjust rating later ?

No, it didn't change until the next Monday which was after the next payday. Back then getting someone on the phone was next to impossible. So I can't really say; however, Recently I noticed you'll get multiple varying answers from the #800 number if they don't give you the usual pre-wrote responses.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
