Granted cervical neck issue then scheduled for C&P?

Question

Question, i was granted 30% cervical neck problem on 24 August and the next week scheduled for a C&P on 14 September for the same issue. Can they do that? They can’t lower or deny the rating with this C&P can they? They would have to show that the issue has gotten better to do that right? It would take more time to get that evidence wouldn’t it? What do you think?

Really strange. Call 800-827-1000 and see what they have on their schedule. If you were awarded 30%, then the claim should have closed. If, however, there were other issues that were deferred,  you may have a C&P for something else.

There are also quality assurance programs run by the Inspector General, so you may have been a lucky one and drew the short straw.

You can also check EBenefits site for open claims, it would also tell you what the C&P may be for if you have an open claim.

I called the C&P office to see what it was for and it was my neck. I do have two issues that are deferred on that claim but, what I think happened was the C&P was scheduled before the decision was made and then never canceled. I got in touch with the director of my RO and he was supposed to check on that for me. I’ll have to call him back in a few days.

Got my final decision yesterday and it’s way over 100% with P&T so my lawyer said that he never says this but he wouldn’t even go to the C&P for my neck because it was just rated the day before it was scheduled and if I’m happy with the 30% then don’t go! It’s on Friday. I may not go!!

Go to the C&P appointment!  Your lawyer has given you bad info.  If you miss the C&P the VA has the right to decrease your rating due to your missing the appointment.  You might need that rating at a further date if your condition gets worse or the VA reevaluates your other ratings.

This C&P is a mistake and was scheduled before I was rated! I was rated on my doctors IMO and IME. They denied me at first but then agreed with the evidence sent in by my doctor. The C&P was scheduled to rate my claim! Since it was rated without the need of this pre-issued C&P this C&P is for nothing! Does that make sense?

    • I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even  reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it. Just about twenty question, and  nothing about stressor,
    • This is the latest Compensation & Pension (C&P) Clinicians Guide dated 20180719. The only other one I've seen is dated 2002, including the one on this website and the VA website. I got this from my claims agent, who got it from the VA.

    • VA has a special where we can ask questions TODAY, at 3:00 to "people that matter?"  Someone should ask why we can not ask them questions EVERY day, why today only? (This is a big problem with VA..the 800 number often does not give specific answers).  We should have people in VA who "solve Vets problems" like Allison Hickey did a few years ago.
