Granted cervical neck issue then scheduled for C&P?

Question

Question, i was granted 30% cervical neck problem on 24 August and the next week scheduled for a C&P on 14 September for the same issue. Can they do that? They can’t lower or deny the rating with this C&P can they? They would have to show that the issue has gotten better to do that right? It would take more time to get that evidence wouldn’t it? What do you think?

if you have been awarded for all your claim issues  then call the C&P Cheif at your VAMC ask if this C&P IS REALLY NESSESSARY?  b/c you have been approved for this claim and rated  and you do not have a NOD in at this time.

other than that go to this C&P B/C they might have other issues to address that would warrant you a higher rating  like inferr the SMC?

Well it could been just a miss read and the C&P may have been scheduled after your claim was decided.

. they tend to f***up at times more often than not , but it would help you if you did call and request they cancel...but make sure there are no other issues like did they apply or infer you SMC if that was warranted?  if not or your condition would not meet the SMC Criteria then ask that this C&P BE CANCELED and allow this time for other Veterans.

Just got off the phone with the C&P office and my appointment was canceled! More good news! Thanks for the suggestion Buddy.

one other thing you may want to do   if your fairly close to your VAMC, Drop by the C&P office ask for a written confirmation on the cancellation. or next time you have an appointment.

  just to have as evidence in case later on they cause you some problems.

better to be safe and sound..do not trust the  Clerks or VA at their word.
