  • Can a 100 percent Disabled Veteran Work and Earn an Income?

    employment 2.jpeg

You’ve just been rated 100% disabled by the Veterans Affairs. After the excitement of finally having the rating you deserve wears off, you start asking questions. One of the first questions that you might ask is this: It’s a legitimate question – rare is the Veteran that finds themselves sitting on the couch eating bon-bons … Continue reading

bva grant, waiting on rating and efective date.

Question

I received a letter from the BVA dated May 24 , 2018 stating that I had been granted service connection for some issues and a remand for other issues. I am still waiting on an effective date and rating. My question is will the VA implement the grant while waiting on the remand? how long does this process usually take? I was ok while my case was on appeal but since I received my grant I have went crazy. I check e benefits 3 times a day and i cannot stop wondering what my new rating is. How long does this process take? I thought I had won my case but nothing has changed. sooo tired of waiting on the VA. Any info on time would be great or any suggestions to speed this up.

Omg, just so sick of the run around.  from everyone.  Called Peggy, and he says they have not got audit back from the coast guard pa office Ras.  Called uscg ras office and she said they had gotten it on oct 3 from va.  And they have 90 days to get it back in.   Do they have to do audit every time you get an increase?  He did see the one they did when he was at 50 to 80 %.   Oh.  Btw he is retired from the uscg. We are supposed to get a bit of retro back.  They have paid the monthly increase for sept. And Oct.

on another note, I ask about the remand for kidney disease and Tdiu.  He Peggy, said, it was sent back to the ro to do what the bva instructed them to do. In our case send out a form to file for tdiu.  Which we did.  Then we had to upload the employers address.  Then it goes back to the bva  for decision.  So now I wonder do we go back to end of line now?

Heres my other question, after we filed  for the tdiu, which they told him to file for,  they sent a letter saying that there was a claim filed in Jan of 2012 and we could not have two in.  We didn’t file one in Jan of 2012.  Could this be a cue on their part.  That was at the same time we filed for the increase in diabetes and chronic kidney failure sc to diabetes.  They did not send us anything at that time to file for  tdiu at that time.  In fact they denied it at the ro.  So is this their way of covering up a mistake?

Treysonna,

I cannot answer the second question but as far as do you go to the back of the line at BVA, no, you were given a docket date when your claim was originally filed.  When your claim goes back after a remand it goes to the docket in the order it was first received so you are ahead of cases at the BVA filed after your appeal was first heard.

Another question.  As some of you know my husband has remand for iu and chronic kidney failure.  He was in the hospital the last part of Aug. he was admitted for blood clot in the lungs again.  The diagnosis beside that was acute kidney failure.  Should we at least inform them to the fact he was in and the diagnosis.  I don’t know what that would do.  But it may be worth a try to push them to advance things.  Or do we file claim and link the embolism secondary to a service connected disability.  Just don’t know if we could link to diabetes,  or heart, or both.  The doctor at hospital did say it put pressure on heart and kidney and diabetes..  just don’t know how to go about it all.

Same situation here.

BVA Partial grant Jul 24

Still waiting for the RO to issue a Rating Decision, and pay the Retro.

9 Years is not long enough for them to screw with you.

    • Type 1 Diabetes recent onset!
I was diagnosed with Type 1 diabetes in September 2017 OUT OF NOWHERE.

i am a Navy Reservist and deployed in later 2009 to mid 2010 and again later 2014 to mid 2015; had a 2 year recall between those deployments.

Only healthcare received since commissioning in 2008 was from the Navy and no issues EVER.

insulin dependent and have dietary restrictions and in a non deployable status.

VA denied initial claim due to Type 1 not showing on active duty and now appealing.

Anyone with successful experience getting a rating with my circumstances?  I live in Upstate New York.

    • Agent Orange Kadena Afb Okinawa
I am looking for anyone who was on Kadena AFB, Okinawa or .Chanute AFB, IL. My dad was there from Oct. 68-April 70. He has ichemic heart disease, diabetes which has resulted in the amputation of his right leg below the knee and peripheral neuropathy. We were denied in 2002 AMVETS filed a claim on his behalf for heart condition, diabetes and back problems. I refiled in December 2011 and have just received the claim statements and medical release forms. I am familiar with filling out this paper work because my husband is a combat veteran of Iraqi Freedom. I have been reading articles from the Japan times and I am a member of the Agent Orange Okinawa facebook page. Another thing that helps make my dad's case is that he was on Chanute AFB, IL and it is on the EPA Superfund list and has PCBs/Pesticides and Dioxins/Furans listed as ground and water contaminants. I welcome any advice, tips or articles that I may have missed in my own research.

    • Appeal granted and closed.
My appeal was granted and closed on November 9.  I got an unofficial notification from the DAV on November 15 stating "appeal granted with an evaluation of 30%" which is great!  My question is this:  How long until I get the official notification from the va? Nothing on ebennies has updated since the appeal closed. Appeal is now in historical and just says complete and at originating va office. I understand no one knows va timelines to a tee but a general timeline would be great.  Thank you all! Hope you have a Merry Christmas!

Edit:  This was my first time appealing and it was a VBA grant.
