Submitting new evidence

Question

I have a claim on appeal and i am considering sending in some new evidence to BVA. According to VETS.GOV my appeal was certified to the board in December 2017 and there is more than 113,00 appeals ahead of mine so i know i have a long wait. I have been checking the status of this appeal on VETS.GOV the past few months and last week a box appeared stating " Decision soon. Submitting new evidence now could delay review of your claim. I don't understand how there could be a decision soon but i am now reluctant to submit anything for fear of causing a delay. Did anyone else see a decision soon message on VETS.GOV? If you have new evidence, yes, it may cause a delay.  However, if this evidence is important, then you are better off to submit it and delay, rather than not submit it and have to appeal.  

If you dont have time to do it right the first time, when will you have time to do it over?

Be ready for BVA 

 

Be ready for BVA Denial!           You have 60 Day request for Direct Request for BVA Denial ending up in form of Judge (CAVC?) Rewarding, Denying, Lawyer Fees (Big $$) while your Denial gets a return back to RO for a redo.

Of course you are right and i will submit the evidence. I just don't understand why they put that" decision soon" box on the vets.gov status. They have a graph showing 113,000 appeals in front of me. I assumed i had close to 2 years before they get to it. I called the BVA number and the lady said they had my file but it has not been uploaded in their system yet. She told me i had time to submit evidence but she could not explain the" decision soon" box and said it made no sense. The vets.gov tracking system is much better than ebenefits but nonsense like this only serves to create confusion. Maybe in the eyes of VA a decision 2 years away is "soon". I am curious if anyone else got a "decision soon" notice on vets.gov and at what point in the appeal did it show up?

I got a "decision soon" box on mine as well and I have 119,000 people in front of me. My attorney contracted a specialist for an IMO and in the letter he wrote there's a time limit and he has to have it by December 30. So maybe it's soon?
