  • Can a 100 percent Disabled Veteran Work and Earn an Income?

    employment 2.jpeg

You’ve just been rated 100% disabled by the Veterans Affairs. After the excitement of finally having the rating you deserve wears off, you start asking questions. One of the first questions that you might ask is this: It’s a legitimate question – rare is the Veteran that finds themselves sitting on the couch eating bon-bons … Continue reading

Secondary Memory Loss PTSD

Question

I am currently rated at 30% for PTSD.  I filed a secondary claim for memory loss, because the medications I am on for PTSD cause me a lot of memory problems.  I had a C&P that I wanted to upload with this, but When I try to attach it says "You do not have any existing attachments.".

Anyway, the claim status on ebenefits is currently "Pending Decision Approval", and I filed on 11/1/2018.  I do not see a change in the VA Letters, or the Disabilities page.  Has anyone else filed for memory loss secondary to PTSD, and I was wondering if someone could kinda guess what percentage they think I will get if any.  I know that's hard to do without a copy of the C&P, so if someone can please tell me how to upload the PDF, that'd be awesome.

As this BVA decision states, memory loss is part of the PTSD rating schedule-

It might not impact your present rating but by all means go to the VA Schedule of Ratings form here and see if you fall into the 50% criteria.

https://www.va.gov/vetapp15/Files2/1511426.txt

To attach files, just click on the Choose files thing below....your PC  file folders should pop up.

I clicked on a file photo of my zinnias to see if I am giving the right advise- it came up automatically here when I clicked on it when it came up in my PC  files, after I clicked on 'choose files.'

I am sure the pdfs should work the same way.

Well I called DAV.  The decision is they are keeping me at 30%.  I really think they should have given an increase to 50%, so I may appeal it.

Question, though, Can I schedule my own C&P exam at the VA and have that as new evidence for an appeal?

ms Berta is correct it has a 50% rating

Occupational and social impairment with reduced reliability and productivity due to such symptoms as: flattened affect; circumstantial, circumlocutory, or stereotyped speech; panic attacks more than once a week; difficulty in understanding complex commands; impairment of short- and long-term memory (e.g., retention of only highly learned material, forgetting to complete tasks); impaired judgment; impaired abstract thinking; disturbances of motivation and mood; difficulty in establishing and maintaining effective work and social relationships. 50%

If you are a TBI veteran check those rating schedules as well TBI has a lot more rating schedules  but some may fall under the PTSD Rating criteria as well.

I definitely have the panic attacks, and they examiner did not even ask about them.  Thanks for all the help.  I will update this when I do appeal, but waiting for the BBE to come in as of now.

If you think that your case needs appeal please do.  Too many times we are told not to appeal our cases but the BVA appears to be more of a friend to veterans than the RO's.

    • Type 1 Diabetes recent onset!
I was diagnosed with Type 1 diabetes in September 2017 OUT OF NOWHERE.

i am a Navy Reservist and deployed in later 2009 to mid 2010 and again later 2014 to mid 2015; had a 2 year recall between those deployments.

Only healthcare received since commissioning in 2008 was from the Navy and no issues EVER.

insulin dependent and have dietary restrictions and in a non deployable status.

VA denied initial claim due to Type 1 not showing on active duty and now appealing.

Anyone with successful experience getting a rating with my circumstances?  I live in Upstate New York.

    • Agent Orange Kadena Afb Okinawa
I am looking for anyone who was on Kadena AFB, Okinawa or .Chanute AFB, IL. My dad was there from Oct. 68-April 70. He has ichemic heart disease, diabetes which has resulted in the amputation of his right leg below the knee and peripheral neuropathy. We were denied in 2002 AMVETS filed a claim on his behalf for heart condition, diabetes and back problems. I refiled in December 2011 and have just received the claim statements and medical release forms. I am familiar with filling out this paper work because my husband is a combat veteran of Iraqi Freedom. I have been reading articles from the Japan times and I am a member of the Agent Orange Okinawa facebook page. Another thing that helps make my dad's case is that he was on Chanute AFB, IL and it is on the EPA Superfund list and has PCBs/Pesticides and Dioxins/Furans listed as ground and water contaminants. I welcome any advice, tips or articles that I may have missed in my own research.

    • Appeal granted and closed.
My appeal was granted and closed on November 9.  I got an unofficial notification from the DAV on November 15 stating "appeal granted with an evaluation of 30%" which is great!  My question is this:  How long until I get the official notification from the va? Nothing on ebennies has updated since the appeal closed. Appeal is now in historical and just says complete and at originating va office. I understand no one knows va timelines to a tee but a general timeline would be great.  Thank you all! Hope you have a Merry Christmas!

Edit:  This was my first time appealing and it was a VBA grant.
