Secondary Memory Loss PTSD

Rate this question

JonathanAD

Question

I am currently rated at 30% for PTSD.  I filed a secondary claim for memory loss, because the medications I am on for PTSD cause me a lot of memory problems.  I had a C&P that I wanted to upload with this, but When I try to attach it says "You do not have any existing attachments.".

Anyway, the claim status on ebenefits is currently "Pending Decision Approval", and I filed on 11/1/2018.  I do not see a change in the VA Letters, or the Disabilities page.  Has anyone else filed for memory loss secondary to PTSD, and I was wondering if someone could kinda guess what percentage they think I will get if any.  I know that's hard to do without a copy of the C&P, so if someone can please tell me how to upload the PDF, that'd be awesome.

As this BVA decision states, memory loss is part of the PTSD rating schedule-

It might not impact your present rating but by all means go to the VA Schedule of Ratings form here and see if you fall into the 50% criteria.

https://www.va.gov/vetapp15/Files2/1511426.txt

To attach files, just click on the Choose files thing below....your PC  file folders should pop up.

I clicked on a file photo of my zinnias to see if I am giving the right advise- it came up automatically here when I clicked on it when it came up in my PC  files, after I clicked on 'choose files.'

I am sure the pdfs should work the same way.

Well I called DAV.  The decision is they are keeping me at 30%.  I really think they should have given an increase to 50%, so I may appeal it.

Question, though, Can I schedule my own C&P exam at the VA and have that as new evidence for an appeal?

ms Berta is correct it has a 50% rating

Occupational and social impairment with reduced reliability and productivity due to such symptoms as: flattened affect; circumstantial, circumlocutory, or stereotyped speech; panic attacks more than once a week; difficulty in understanding complex commands; impairment of short- and long-term memory (e.g., retention of only highly learned material, forgetting to complete tasks); impaired judgment; impaired abstract thinking; disturbances of motivation and mood; difficulty in establishing and maintaining effective work and social relationships. 50%

If you are a TBI veteran check those rating schedules as well TBI has a lot more rating schedules  but some may fall under the PTSD Rating criteria as well.

I definitely have the panic attacks, and they examiner did not even ask about them.  Thanks for all the help.  I will update this when I do appeal, but waiting for the BBE to come in as of now.

I am not sure if every examiner goes by the same set of what to ask but my examiner was very patient and asked a lot and I am waiting on my decision as well. I am not sure if they will rate 30 or 50 or whatever. I saw you mentioned memory loss and for me its memory loss on things like directions, getting lost or even getting side tracked and going one direction and then next thing I know, I am in the wrong direction etc. its not major but its little things that have annoyed others including myself. Not sure how they rate anxiety like if you cant take public transportation. Thing is, the work thing is ok with me, its the social life that has taken a hit and not sure if you need both to be at 50 or above. Either way, its hard to determine based off what i read from others and i also think the examiner is huge. If they just blow by and not capture the details like are you ever triggered, how? Then the examine might lack the whole story. I wrote down several examples, had several bullet points, listed out details to insure I did not forget something because I wanted to make sure the exam captured everything.
