  • Can a 100 percent Disabled Veteran Work and Earn an Income?

    employment 2.jpeg

You’ve just been rated 100% disabled by the Veterans Affairs. After the excitement of finally having the rating you deserve wears off, you start asking questions. One of the first questions that you might ask is this: It’s a legitimate question – rare is the Veteran that finds themselves sitting on the couch eating bon-bons … Continue reading

Claims Timeline--- Where do I find the completed DBQ exam?

Question

First time poster! I just discovered had it and have been reading so much great information on here. I'm currently rated at 90% and have 5 pending claims.

I need three 20's and one 10 to get to 100%(pretty confident that I'll get there but, the VA is weird).

Here's the timeline on my open claim:

Initial Submission-- 12/13/2018

C&P Exam Date: 1/2/2019

Prep for Decision: 1/4/2019

It's moving a lot faster than expected. Not sure if the process will keep moving fast or, hit a brick wall. You never know with the VA

From what I've been reading, there is a way to access your DBQ exam online...can someone tell me how to do that? I've been looking everywhere and can't find it to save my life.

Also if you have the information or phone # or fax# for  LHI Contracting service for the VA..you can call them or fax them  request a copy of your C&P Exam done on this date,,,,as for as I know Veterans have that right  after all its your medical record.

LHI Should have sent you a packet of information about them and how they will conduct your C&P Exam ,time and location ,name of the examiner and his/her qualifications  ect,,,ect,, along LHI  Address and phone &Fax #'s

Information that you need.

My claims (5) for increase and secondaries went quite fast, 2 months total.  My C&P exams where done at a VA hospital and were on myHealthyVet within 3 days.

I think Congress needs to address this and make the VA post outside contractors as well, and in the same time-frame.

Anyway, good luck on moving that much when you're at the top of the rating chart.  I was at 81 and went to 91 with one new 30 and three new 10's.  Hard to make big move when you're near the top.  I need a 40 to make 95 now.  Every two years I get everything evaluated to see if any have progressed.  Seems to work for me.  Just can't expect to world right away.

Keep us posted,

Hamslice

I have not got my letter yet to see if there is any movement there either.  Got the requisite life insurance brochure today, so the letter should be right behind it... LOL..

wait a few weeks and go to your local VAMC @ the VBA (Veterans Benefits Administration) Office, Request a copy of your C&P Dated on**/**/**** You just go up to the window sign a FOIA and on this piece of paper  request a copy of your last C&P  contractor LHI, they should let a VSO see you back in his office,  he has access to the VBMS and can look on the computer for your C&P Exam.

Unless they stopped doing this for Veterans? ..I did this in 2014

Note: when you go up to the window and the Clerk ask  ''if they can help you''  just ask if you can see a VSO about your benefits, you don't need to tell them the reason why...this is what you ask the VSO.

I did this at the Oakland VARO and got copies of my C&P exam.  I also contacted my VSO and they faxed other C&P exams to me.  I went to the VARO to see how the process worked.  They are definitely overworked at the VARO so the VSO route or if you're represented by a law firm is the way to go to get the copies.

Why we as veterans don't have access to VBMS is beyond me.  If we're working our own claim we should be able to have access.

I agree.  Its more than just "not fair" we dont have access to VBMS, its a violation of due diligence, 38 CFR 3.103 and CFR 4.6.

Wow! 2 months? Looks like the VA is doing a little better for some of us these days.

One 30 and three 10s would definitely put me at 100%....hope I make it to the "sacred land" of 100%

I'll definitely keep you guys posted on how this works out for me. Wish me luck!

    • Appeal granted and closed.
My appeal was granted and closed on November 9.  I got an unofficial notification from the DAV on November 15 stating "appeal granted with an evaluation of 30%" which is great!  My question is this:  How long until I get the official notification from the va? Nothing on ebennies has updated since the appeal closed. Appeal is now in historical and just says complete and at originating va office. I understand no one knows va timelines to a tee but a general timeline would be great.  Thank you all! Hope you have a Merry Christmas!

Edit:  This was my first time appealing and it was a VBA grant.

    • Question About Temporary 100% Rating for Hospitalization
Hey all. I've searched all over the net, and read the CFR on the topic. I will be going to PTSD Dom inpatient treatment here soon. I read that it's possible to get 100% temp for hospitalization. However, the CFR says that PTSD Dom does not qualify, but then in the exceptions it says that it may. Does anyone know if I will qualify for temp 100%. I will be in there for almost 2 months. Here is the CFR code, and the part regarding the matter-

Do not apply the provisions of 38 CFR 4.29 when a Veteran

is treated as a resident in a State Veterans’ home is currently receiving a total rating for the disability for which hospitalization was required is a resident in a VA domiciliary program, or is a participant in a live-in/work out program being utilized to facilitate transition to community living.

      Exceptions:
Hospitalization in excess of 21 days for an SC disability in a medical facility located at a State Veterans’ home may entitle the Veteran to hospitalization benefits. Veterans are entitled to hospitalization benefits for treatment in excess of 21 days in a day hospital program if the treatment given is consistent with hospital care for a SC disability even though they are concurrently required to be housed in a VA domiciliary.

The exceptions part is confusing me. Does anyone know if I am entitled to a temporary 100% rating? I'm currently rated for the same reason I'm going inpatient.
