Primary Physician for Sleep Apnea C&P

Question

Hello All,

I recently submitted a claim for Sleep Apnea secondary to depressive disorder on Friday (1/25). Along with submitting the claim I submitted and IMO from a non-VA doctor.  Today Tuesday 1/29 got a call to schedule my C&P. (World Record to me) Was wondering if anyone else thought this was weird and they also said that my C&P exam was going to be conducted with a Primary Physician not a Sleep Specialist.  I also just thought about it. I didn't submit a DBQ with my initial claim. Could this be the reason? Just seemed off I'm not going to a specialist.

Well, an update for you. My claim was denied. Just checked today and it was completed and no change.

Any advise on how to rapid appeal?

My claim was denied also. That was my third time getting denied, so I got with a lawyer. I went with Chisholm & Chisholm Kilpatrick. Hill & Ponton is reputable also.

CCK is doing it pro bono. If I get denied again, I don't owe them anything. But, if I get it granted they're asking for 30% from the retropay. I don't mind it because I'll see that money anyway after a few months.

How long has it been since the original claim? If it has been more than a year I would hire an attorney to assist you.  Granted they get 20% of the back pay but in the end I think it will be worth it.

My intent to file was done in Feb 2018. I submitted the claim Jan 2019.
