Re-open and reconsideration claims - New Changes - AMA

Question

Just a heads up, as of February 19, 2019, if a Veteran is wanting to submit a claim for contentions that are reconsiderations or reopens, the 526ez is no longer the authorized form and will no longer be accepted per Appeals Modernization Act (AMA) guidelines.

I suggest anyone looking for more information to take a look at the VA Form 20-0998 which can be found at https://www.vba.va.gov/pubs/forms/VBA-20-0998-ARE.pdf

or

https://benefits.va.gov/benefits/appeals.asp

and

https://www.blogs.va.gov/VAntage/56694/vas-appeals-modernization-act-takes-effect-today/

and

https://www.va.gov/decision-reviews/

The authorized forms to submit the aforementioned types of claims are as follows:

VA Form 20-0995 for supplemental claims, which can be found at https://www.vba.va.gov/pubs/forms/VBA-20-0995-ARE.pdf

VA Form 20-0996 for Higher Level Revies claims, which can be found at https://www.vba.va.gov/pubs/forms/VBA-20-0996-ARE.pdf

and

VA Form 10182 Decision Review Request: Board of Appeal https://www.va.gov/decision-reviews/forms/board-appeal-10182.pdf

If you submit a claim pertaining to a contention that was previously denied using a 526ez, no action will be taken on that claim. You will simply get a letter stating that you need to download one of the aforementioned forms. The 526ez is still authorized for new contentions and for increases.

EDIT

**********

Any claims with re-open or reconsiderations prior to the specified date are treated as they were before. There is no need to re-submit anything.

dajoker12, thank you very much for the heads up.  Great response to some tough feedback from our fellow vets.  Lighten up folks.

Pedro and @dajoker12. I hope dajoker12 understands we understand dajoker12 is only here to help and brings a lot of knowledge that will help veterans.  We appreciate his knowledge and help.  We are not intending to insult anyone, we are only expressing frustration with a system that overly complex and not always veteran friendly.

I am assuming any claims submitted ebenefits will still be ok?

Yes, any claims submitted before 2/19/2019 will be processed/developed as they previously were.

I appreciate dajoker12 informing us about these New Claim Forms!!!

The 21 -526ez was designed for the VBMS to take /copy and accept the form,  now with these new forms...we Know.

If you still use the old 21-526ez AFTER 2 -19-19  it will slow your claim down and you may have to start all over...so unless you have all the time in the world like dajoker12 mention go ahead and use the 21-526ez

I think broncovet was just being sarcastic as he is frustrated with his appeals for EED SINCE 2002/2003/2006.

The VA Rater failed to read his new & materiel evidence and was denied..I Can understand his frustration

All of us Veterans appreciate all the information and new changes the VA has made...its months before were informed by the VA, and any new things that the VA has that we don't know about  and to have this information coming from within the VA System from a VSRO/ Is much appreciated.

I have done an intent to file but have not submitted it yet because I am still gathering info.  So my next question is this.  Should I cancel that intent to file and start a new one? My current intent to file was started last month.
