FDC 4 TDIU is C&P exam necessary

Rate this question

Amazing Becky

Question

The Baltimore RO received my IU claim on 04/30/2019. It’s is an FDC and includes a DBQ from my therapist. Will I still need a c&p exam? The last one was done in 2016 and it was brutal. I’m hoping to avoid a repeat. Right now my claim is in Initial review. Has anyone had a claim that jumped from the Initial Review to Prep for Decision approval and how long did the whole process take?

@Amazing Becky, It is late and I am not feeling well tonight and I have a long day tomorrow.  I will get more information to you Wednesday. Congratulations on your TDIU.  Total and permanent also comes with some medical benefits.

@Amazing Becky, I am getting back to you a day late.

I also got out with a general discharge.  What I would do is to go to this website https://www.army.mil/standto/archive_2017-12-11 and fill out an online or mailed in application for correction of military record.  Number 5 would be that you were released from the military with a general discharge while you had PTSD.  Number 6 would be that you are requesting your record be updated to retirement due to medical reasons as you were suffering from PTSD at the time of your discharge.  It is usually a long shot but it can be done and if you are given 30% or more military retirement you have all of the benefits of a retired serviceman.  There is no pay increase but that is no big deal if you can get retirement.

If you are good with words you can be much more eloquent that I am.

I would also read: https://codes.findlaw.com/us/title-10-armed-forces/10-usc-sect-1201.html and https://statecodesfiles.justia.com/us/2011/title-10/subtitle-a/part-ii/chapter-61/section-1201/document.pdf and https://www.law.cornell.edu/uscode/text/10/subtitle-A/part-II/chapter-79 and https://uscode.house.gov/view.xhtml?path=/prelim%40title10/subtitleA/part2/chapter79&edition=prelim

When I filed my claim I was reactivated for a day to sit before a retirement board at a base near my home.  I hired the lawyer that was recommended to me but he was working for the enemy.  I was offered a 30% retirement and said no I wanted fifty.  My lawyer stated that I did not take 30% he would walk and I would be denied.  Just an interesting side story.  I was retired at 30% and receive all benefits of a retired serviceman.
