Claimed Denied Dec 2014 (Legacy)

Submitted NOD in Jun 2015 (Legacy)

Opted into RAMP July 2018

Denied Ramp May 2019

Supplemental Claim open June 2019 ( In decision phase now per VA)

 

Flat feet (aggrivated due to ) From original claim date ( new DBQ, Medical opinion, Nexus, lay statement) On supplemental claim

Knee condition from original claim date  also supplemental claim (New DBQ, Medical opinion, Nexus , Lay statement) on supplemental claim

Back condition from original claim date rated 20%

Fibro Denied

Hip condition denied

I am waiting to see how this comes out (nerve racking)

That should change over to the AMA and out of Legacy  if you use a VSO have him/her to check on that??

..8 years in appeals is way to long and since the merge of this new  AMA system it is suppose to be reduce down to 125 days or less.

Mine go back to 2010.  Finally got them approved via a supplemental claim that I filed in February 2020.  Unfortunately, they made the effective date the date that I filed the supplemental claim even though I continuously pursued the claims through the legacy appeals process. It was remanded and sat for awhile until I filed an HLR that was denied and then approved on the supplemental.  I have an HLR in now to fix the effective date.  Still waiting on an informal conference.  

I have new claims in now that I'm waiting on LHI to schedule exams.

Had my exams yesterday. The doctor tried to rush through but I talk to him to slow him down. I think it well but we see.

I have a question, I think its a good question. When VA rates disabilities for instance foot disabilities. How do they assign ratings? I have PES Planus with Plantar Fasciitis, also arthritis in my toes, metatarsalgia, and bunions how would this be rated. Would they separate and rate each individual or pick the highest (which does not make sense). Did I read the regulation right,  that if the disabilities have a code it should be rated separately if the symptoms do not overlap. If, then I am granted the disability with higher rating. Right

Miken2c74 You're basically correct. The VA doesn't want pyramiding so there is no double payments for the sme disability. So you need first to know what is the criteria for rating the condition you have. If there is no mention of arthritis, then you get the first condition, plantar fasciitis s-c first, then get an IMO from a specialist that says it caused the secondary condition, arthritis. You can get several ratings on arthritis, say for example, your toe and your ankle.
