Original claim opened in Nov 2013 (Legacy)

Claimed Denied Dec 2014 (Legacy)

Submitted NOD in Jun 2015 (Legacy)

Opted into RAMP July 2018

Denied Ramp May 2019

Supplemental Claim open June 2019 ( In decision phase now per VA)

 

Flat feet (aggrivated due to ) From original claim date ( new DBQ, Medical opinion, Nexus, lay statement) On supplemental claim

Knee condition from original claim date  also supplemental claim (New DBQ, Medical opinion, Nexus , Lay statement) on supplemental claim

Back condition from original claim date rated 20%

Fibro Denied

Hip condition denied

I am waiting to see how this comes out (nerve racking)

Well hell all my claims came back denied. I am not mad, I am still fighting.  So I was diagnosed with migraines but was not service-connected for it, they said my CCMD (Anxiety was not enough to contribute to my migraines). Denied sciatica because they say I was not a doctor, to say that the pain in my ass cheek " may" something to do with my lower back condition which and possibly have something to do with my sciatic nerve which Sciatica is layperson term. My GI denied whatever.

Miken2c74 An't no fun. Get your decision letter. Read it and then read it again. Take the reason for denial and really understand. Then go out after what they say you fall short on. If it is lack of diagnosis for back pain and nexus, get an expert medical opinion that opines in support. You're still a young guy; if the disabilities you are after get get you to a combinesd 70 or 80%, that's a lot of beans over the next 25-30 years. Think of it as an investment. Not all investments turn out great, but if you do your homework and vet the medical expert for your IMO, your chances are a lot better. Don't give up, you ain't done yet.

So I had an interested week last week. I sent an 20-0995 and a statement to my VSO to submit to VA. My VSO had the nerve to tell me, in so many words "that they were not going to submit it because there was not enough in my file to constitute reopening the claim. I answered "HUH"?. This is the letter I sent to them. They say they understand the argument, and in this instance understanding "Presumptive" is the Nexus. They say i need an IMO. Tell me what you think.

OK, you do need a nexus.  Look at it this way, there is already a medical opinion on records that yes you have fibromyalgia but the medical opinion states that it is not military/service related so you will need equal weight, a nexus medical opinion that it is as least likely as not caused by or related to your military service. Yes, I know of the presumptive but VA will not take a veterans word for it and once a negative opinion gets in the file then it is a fight to get service connection. I don't like the fact that your VSO refused to file the claim. A nexus letter/statement would hold more or equal weight if it came from an Internal Medicine Specialist or a Rheumatologist.

I am going to be a little blunt here so please try to understand my point. You as the veteran can write all the statements and disagreements until you are blue in the face.  VA will not change their decision unless you smack them in the head (not literally) with equal medical opinions.  If they have medical opinions then you get medical opinions (not yours, a licensed medical professional)  refuting what the medical examiners stated. You can use VA or Private Medical Doctors but get referrals to specialist working in their medical profession. Have them review your SMRs and VA/Private treatment records and write their opinion. In filing appeals, your claim(s) may have to be appealed to BVA and or CVAC and then you will definitely need medical opinions that agree with your claims.  I took a brief and I do mean a brief look at some of your post in this thread and in my opinion don't shoot yourself in the foot. You fight fire with fire in these cases. Pull out the big guns (not literally) get those medical opinions and get your service connections.
