Question

When I applied for a vehicle the first time,  due to disability, it took two years of back and forth on forms, who to talk to, and getting updates. I now am ready for a second vehicle and would like to know who should I go to to complete the 10-1394 so It doesn't get kicked back in my face a dozen times. On the form it says to bring it to your regional office.  But it doesn't say to whom. I'm also told that I will have to go through the VA drivers test to qualify. Who sets this up? Will the VA do it on their own, or do I have to initiate something? And what? After waiting for two years the last time, where can I get some help?10-1394-fill (1).

That IS a question I would try out with Peggy. Why not? Anyone you call will just give you the run around anyway. Might as well start with her first.By the way, Blueboy, what part of the state you hale from? I'm from Ct. too.

Peggy is the general info line the VA has: 1-800-827-1000. Not always reliable, or have timely info, but sometimes can provide a status.

Ok.. its really simple.. since you were already awarded the  vehicle grant and initial adaptive equipment by the rating authorities. 

You cannot add more than 2 vehicle to the adaptive vehicle program every 4 years. 

After the first grant, the VA will only pay for the adaptive equipment for any new or used vehicle.

The paper work goes to the person at your VA Medical Center that is responsible for the auto adaptive equipment. They are normally located in the Prosthetic Department.   If you are purchasing a new ramp van

then  you need to notify the responsible person prior to the purchase to make sure they are going to make payment for the $30,000 plus cost of the adaptive portion of the van. You will be responsible to pay for the

actual vehicle. Most of these vans new will cost $60,000 or more.

If you are purchasing any vehicle other than a ramp van, you don't need to do any checking. You purchase the vehicle and then submit the paperwork to the adaptive equipment person and they will verify the

paperwork is correct and then it gets forwarded to the regional office in your state where they make the final approval and payment.  

So.. let me be clear.. if you purchase a ramp van the va will pay for the lowered floor and ramp system, as well as any wheelchair docking systems... they pay this directly to the vender

Depending on your disability, you may be reimbursed for power steering, power brakes, air conditioner, automatic windows, cruise control and other normal items that are considered adaptive equipment this

reimbursement will go directly to you.

You must provide a copy of the window sticker, bill of sale, registration, and copy of your drivers license. If you trade in a vehicle that was in the program you must provide proof of the trade in, or sale of the vehicle .

I won't get a window sticker. bill of sale, etc. until after  buy the vehicle. But I can't buy it unless it's approved. What do I send in with the initial form 10-1394?

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
