Question

The last time I was on this site I left with a very bad feeling ( almost an insult). However I am going to ask this one time in hopes for an answer to my question. I did try contacting Chris Attig as well as other sources and never was able to speak to anyone. If there is a way to speak with someone regarding my issue could someone be so kind as to provide me with it?? I think Miss Berta could answer my question but not sure she would want to. I have called the VA 800 number and they knew nothing about what I was asking. Hope i might get some positive kind response today.

If you wish to actually speak to someone, this being a blog/forum, it is going to be difficult. You probably have to send a message to a specific person, say an elder, and trade phone numbers with them if they wish to do so. Not having any idea what your issue is, it may not be very fruitful for you. If you wish, select an icon of the person you want to address and send them a private note. Good luck.

If you are looking for assistance with claims there is @asknod from everything I read he is very knowledgeable. JMO

I am not an attorney or an a credited VA rep. These are my personal opinions and experiences, always remember what worked for me may not work for you.

You as the veteran are your own best advocate and no one knows your disabilities better than you. It is highly recommended that you as the veteran research and verify that any opinion given meets your specific situation.

Ann, I am sorry you left with a bad feeling.  Please ask your question and someone will help you.  I am not on much recently because I am moving but message me and I will get an email.  Please let Tbird know what happened, she would be very interested.

Sorry we aren't set up to take individual calls. You can post your question and see if you can get an answer. Or try an attorney https://vetlawyers.com might be helpful, I've used them and they have a good reputation. Chris Attig use to only take cases that affect a lot of veterans, but not sure if that is still the case.

 Ms berta and I and some other recommended she obtain an experience VA Attorney or Accredited VA Claims Agent.

I recommended NOVA and I believe broncovet did too!

You dont need them. The veteran was already determined to have died from an AO disability,due to his service in Vietnam.

The EED for DIC was the date the VA received proof that the veteran had an AO presumptive.

“As explained above, the appellant did not appeal the denial by submitting a timely Notice of Disagreement or other indication of disagreement with the administrative decision within one year.  The November 2000 denial of her DIC claim consequently became final.  38 C.F.R. §§ 20.302, 20.1103 (2017). 

 

The appellant's next submission was a written statement requesting to reopen the previously denied claim for DIC was received in January 2010 at the RO.  Along with the new claim in January 2010, the appellant also submitted the autopsy report dated May 2000, the month of the Veteran's death.  The cause of death listed on the autopsy report is "widely metastatic small cell undifferentiated carcinoma of the right lung."  Based on the autopsy report, in October 2010, the RO granted DIC for service connection for death as a result of the Veteran's presumed exposure to Agent Orange in the Republic of Vietnam and subsequent development of lung cancer, a condition listed in 38 C.F.R. § 3.309.  The effective date was January 27, 2010, the date the appellant submitted the request to reopen the DIC claim. 

In the Board hearing in August 2016, the appellant testified that she had not submitted the autopsy report in 2000 because either it was not produced at that time, she was not asked for it, or she did not have it.  The evidence of record shows that the RO contacted the appellant directly via letter in August 2000 and requested a copy of the autopsy report.  The death certificate dated May 15, 2000 indicates that an autopsy had already been completed and the findings were available prior to completion of the cause of death on the certificate.  The autopsy report states that the appellant authorized the autopsy, which was completed on May 13, 2000. 

 

The Board finds that an effective date earlier than January 27, 2010 for the appellant's award of entitlement to DIC is not warranted.  The November 2000 rating decision was final.  Thus the appropriate effective date for the entitlement to DIC for the appellant is the date of receipt of the new claim in January 2010.  38 C.F.R. § 3.400(c)(2) (2017).

The VA cannot make an EED award based on evidence they do not have.

I and many others here have tried to answer all of your questions   but today the question  has a different nuance-? Today you said:

I am not looking to continue with DIC"

so what benefit would a different EED have to you?

Ann probably was upset at my last post to her -because I am not here to tell people what they want to hear- 

And sometimes they do not want to hear  and understand how VA case law and regulations control our claims.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
