Legacy Appeal- How long on Docket

Question

Hi Everyone,

I’ve been waiting for a hearing for over 5 years. I got the 90 day letter in 2/19. I’ve been on the judges docket ever since then but still have not had a hearing. It’s now end of September 2019. Does anyone have a guess of how long I still have to wait until my video hearing?

If we knew your docket number we could take a guess, since those are done in docket number order.  You see, the VARO sits on your appeal in legacy appeals for serveral years before its even passed to the BVA judge.  

They sit on it to do a SOC,

Then, they sit on it to certify your appeal to the BVA.  

Just the SOC and cerfitfying it to the BVA take a few years.  

You should have had a hearing, or one scheduled before 5 years.  You should get to the bottom of that.  

Call your VSO, or call Peggy.
