Partial VA disability compensation award???

Question

Howdy!,

A interesting 24 hours has seen my VA compensation claim go from gathering evidence and review to notification (awarded 80%)  and then back to gathering of evidence depending on what web site I look at. I THINK what has happened is I have what is termed a "partial award", a commitment to move forward and award me on claims that are clear cut but I also see items that are tagged as deferred (looking at e-benefits , no official explanation letter yet and the VA won't engage in dialog lol). Ironically one of my claims that is deferred is sleep apnea. That's pretty much a no brainer. I had a sleep study over a year back, was diagnosed with chronic severe OSA through referrals that my MTF put forth. I am assuming that some how what I uploaded and or lack of information presented to them from my service has brought them pause and they will shortly be looking for additional data and or a P&C eval to verify it.

So am I being presumptive that the VA did indeed award a partial with more to follow on a few other items? If that's the case then hats off to them for having some discretion in the name of service and efficiency . Second is of all things the sleep apnea is a hard one to screw up! The stuff I uploaded is very subjective like most other things. Lots of data and graphs from a high tech sleep center. Even my CPAP machine uploads to a cloud and has a back up SD card.

So any enlightenment you can shed on this I am always looking to learn something. Thanks, Matt

I have been enrolled in VA health care since 1986.  I got retired and received Tricare in 1990.  I now only use the VA for my once a year appointments and some neurological care on the civilian side that the VA administers.

I am lucky to have tricare also, I don't want to use the VA except for CPAP equipment.

I guess I will need to have the VA PCM also do annual physicals even though I have them at Ft Eustis where my tricare PCM is located.

Howdy,

To circle back I did get my letter and it is indeed a partial. 80% for now, retro to 1 October and then a few P&C exams that I guess they decided they wanted for a dominant hand , foot and deviated septum that they punted on initially. Ironically one of the items listed as "deferred", need more info is my sleep apnea. I called them a few months back concerned that documentation I had uploaded (didn't have a rep, did this myself) was no longer showing online. They checked and indicated they have it all and to not worry if I couldn't see it. The letter stated that need to schedule and or see copies of my sleep study. That was the exact thing I pointed out to them was missing so they have it again and I dodge having to do a study.

So they have it now..again and it shows severe OSA so I suspect that will be easy. Also after looking over their rulings I don't have any bones to pick about where I landed on the items they rated. In doing my research I had taken a hard look and created a word doc with my best guess assumptions and it is a match. The apnea should put me at 90% and then we will see if the other change that.

So I did BDD on this. Submitted my stuff 6/19/2019, started hitting my P&C exams while on terminal 5 July. Finished all the exams 1 Aug. Waited for confirmation from QTC that my full package had been submitted to VA and submitted the form that I had no more evidence to submit on 8 August. Received my rating 13 November.

So it would have been nice to get it done the very first shot but appreciate the fact that the VA has the discretion to award a partial while they dig deeper.

I am learning. Thanks for the help.
