TDIU and marginally working

Question

Hello and thank you for reading. I am rated at 90% but get 100% TDIU. I have worked off and on jobs that aren’t anywhere close to meeting that poverty thresh hold amount. I enjoy working but with my disabilities I just can’t be around alot of people and I end up running out of the place in tears.  Anyways my question is does anyone work a little on TDIU? What encounters have you had with VA about it? Thank you so much.

It can vary on your situation, the kind of work you are able to do, and your work environment.

Some TDIU veterans actually are able to work full time and make above the poverty threshold because their work environment is considered a sheltered work environment.

I'm not TDIU, but am P&T and have been able to remain working because my employer provided me with accommodations. in effect, they created a sheltered work environment. I was having serious problems working in a cubicle, but finally got moved to a private office where I can close the door. I call in to meetings instead of having to show up in person. Yes, I still have to see other people in small doses when I enter or leave and when using the facilities. It is like I am a full telecommuter, but from an office building. I would go full time remote, but my home is way too small and I don't have fast enough Internet. It's not 100% better, but is adequate enough that I can function on most days.

Not sure if this information helps, but that's what I am doing.

Yes.  Never lie to VA, or misrepesent how much you are working.  

  There is a form you will need to send in once a year where you tell VA how much you worked that year.  

TDIU is defined as "the inability to secure and maintain substantial gainful employment due to SC condition(s).  They also define SGE as at the poverty level.  

It sounds like you dont have a "real" SGE job.  

It sounds like you have "marginal" employment, where you can only hit and miss for relatively short periods of time.  This is not unusual.  The VA wont take your tdiu away because you cut the neighbors grass twice a week in the summer and shovel his walks in the winter.  

The VA and social security "talk" to each other, and VA knows when you are working SGE.  (I even heard they were eliminating that annual form for tdiu, but dont know the status of that.)  

Enjoy your marginal employment.

Thank you for your reply. Yes SSA and VA do “talk” now so they did away with the yearly letter this year actually. No, I never hide anything from the VA. The little jobs I have had here and there are all above board and I pay taxes so they are reported etc....Thank you again. Happy Holidays.
