pending appeal

Question

I was granted 100% in April, '19, however other claim still pending from 2013 (appeal and deferred)....WHEN that's approved...will they give me a % difference from 2013 (I'm already 100...so I'm good there)...but I'm curious what will happen when the other claim is approved.

Short answer:  We dont know what the decision maker will decide.  

If you are awarded 100 percent from 2013-2019, and you did not receive any compensation for that period, the you should get 6 years of retro at 100 percent.  

Its also possible that you "could" meet the criteria for statuatory SMC S  which is a single disability at 100 percent plus other disabilities seperate and distinct combining to 60 percent.  That would mean about an addition 350 per month times about the number of months.  

So you have retro possibilities of 350 per month times six years and/or almost 3000 per month times six years (depending upon your number of dependents.)

We dont know what the effective date will be, but the general rule is the effective date is the later of "facts found" or the date you applied.  There are multiple exceptions to this.
