Ok.  Fast forward.  You did not see that truck coming!!!  Now, your spouse thinks (after all the smoke clears and you are buried):

  What is your family going to do?  Hmmmm...I guess he filed an appeal for VA benefits..so what happens now?  I dunno.  WAIT!!!! I remember something he said..."Honey if I die, please contact my attorney and tell him of my passing and you want to file a substitution of claimant".  

Else:  VA wins!!!  They "delayed until you died".  Dont let the VA win THAT way, anyway!!!

Have your spouse:

1.  File for substitution of claimant, use your attorney or VSO.  Just keep going with the appeal, "as if" you are still alive and your family gets the retro.  How cool to send your grandkids to college on your retro!!!!

2.  File for DIC.  Hint:  If you died of a service connected condition OR if you died for any reason (and you were 100 percent P and T for 10 years) then you get DIC.  

    So, please inform your spouse of your choice of representative (law firm, VSO, or non attorney practioner) and have them contact them when you pass.  Tell her you want her to continue your claim (or appeal) with a substitution of claimant.  

    Remember:  VA wins your claim if you die and no substitution of claimant is filed.
