Secondary claim

Question

I'm in need of a reality check. I have claims for both hips and L knee secondary to a service connected R knee and I recently came across this in my VA record from 15 yrs ago..

Impression:.  Hips

Osteoarthritis, left hip more advanced than right. MRI documented AVN, left femoral head gait abnormality/deconditioning related to chronic right knee pain

Is that not a smoking gun?   And yes I'm aware there's no such thing with the VA.  Thank you

Its certainly "evidence" (favorable) but you still need the "2" Caluza elements for Secondary service connection.

1.  Current diagnosis.

2.  Nexus, or doctors opinion that (secondary condition) is "at least as likely as not" due to (primary condition).

Your statement is close, and it may even work.  I "like" it when its in the "at least as likely as not" format, and so does VA.

I agree that you need the caluza events as bronco stated.  You are right there is no smoking gun with the VA.  If they deny it as related to the knee problem request a supplemental claim with new evidence.

I agree.

Why not try to have hip service connected by itself?

Or was hip a direct result of knee issue in service?

Stay positive and you are on the right path.
