Duty to assist errors sent for correction

Question

Hi,

Can you tell me what usually happens with duty to assist errors that are sent for correction?  Is a supplemental claim opened?  I received the decision letter from my higher level review, but it still shows as open and a supplemental claim was not created.

Mostly VA does not "open Supplemental claims" absent a request from you or your representative.  

To get the answer to your question, you will likely need VBMS access.  Your VSO may have that, we do not.  It may not matter that much, tho, and here is why:

 1.  Did the decision letter award benefits?

  2.  Did you like the decision..was it at a disabiity percentage and effective date you thought was fair?

  If you were denied, lowballed, or given the wrong effective date, then file a NOD.  

If the disability percentage and effective date was fair and you agree with it, then you dont need to worry about DTA (Duty to assist) errors.
