Various Conditions Lumped Under One

Question

Hello all,

I just received my claim back and it was a little confusing for someone like me.

They put together MS, MDD, and TBI all under one disability with 30%, 70%, 10% respectively, but then overall rating for that disability was 70 given it was the highest.

Is this because of the so-called pyramiding?  I mean it just doesn't seem to make sense, but who knows.

Symptoms of MDD and the symptoms of TBI VA says that they cannot distinguish between the two disabilities and they are both rated under mental disorders.  read this it might help

The good news is that you are rated for TBI, this causes symptoms down the line for most.  You now have the opportunity to request a secondary disability that is related to your TBI if it ever crops up.  The VA will only rate you for one disability under mental health no matter how many you have, yes that is to prevent pyramiding.  You did well if this is your first time out.  You can work and continue to receive this rating if you are able.  If not able to work I would see about requesting TDIU.
