The VA is posting in the Federal Register soon, some changes to this program that  hopefully will make it better.

I suggest you might do a google alert for more info on this as it occurs.

I expect VA to allow for public comment on this proposed change and I also hope many vets and their family members will comment at the Fed Register site when the proposals  go on line.

VA does read over all comments.

Lawyers ,vet reps, vet orgs ,  family members and vets ( only a few of us here at hadit) challenged ,in the public comment section, the 2010 PTSD regs but we failed to convince the VA of what we wanted.

The new 2010 regs said that Only a VA MH doctor's diagnosis of PTSD is acceptable to the VA.....but a vet could possibly overcome a C & P exam that fails- to diagnose PTSD-if they have the stressor criteria solid, by obtaining an IMO./IME from a non VA MH doctor.( which could be costly to the veteran)

The 2010 regulations however are geared to making OIF/OEF have an easier time obtaining their proper comp.

Any vet with the PH, CAR , and /or CIB on their DD 214 should have their stressor conceded by the VA with no VA BS. But we had one member here with a CIB and they kept denying him.

He never posted his denial -so we could not help him.

BTW, any veteran who feels his/her DD214 does Not contain all awards, decorations etc should use a DD 149 form( available here) and apply for a DD 215.

Read the form carefully and also make sure you send it to the proper address as on the Instruction list.( keep copy and proof of maiing for your records- VA will send you a any additional ribbons, medals etc as well but also they will tell you you have to purchase any medals th DD 215 lists, from the Vietnamese Gov , at a PX BX  or on line.

The VA cant deny A and A if your spouse is the caregiver.  See 38 cfr 3.352 (c):

Have you applied for A and A, or do you meet the criteria?  A and A is seperate from "caregiver", but VA can pay you an additional 700 or so a month to be your caregiver, provided that you meet the critiera, and apply for A and A.
