Collecting unemployment while applying for tdiu

Question

My unemployment compensation runs out in April. I am applying for tdiu. I am unable to find work because i failed a fitness for duty and was terminated. This has all been reported to the VA. 

Will collecting unemployment hurt my chances of tdiu? I have been ruled unable to work or unemployable by my doctors. This was also submitted to the VA.  i have to make ends meet i have continued to collect this money while going thru the process of applying for tdiu.

No  if it runs out April 1ST   IF YOUR APPROVED FOR IU   They will go by your filing date

WHEN DID YOU FILE FOR THE IU? WHAT DATE DID YOU FILE?

Even though all this was submitted to the VA  Your going to need letter from a qualified Dr to render his opinion that he has examanin you and read your medical records,  AND SAYS YOU CAN'T WORK DUE TO YOUR S.C. DISABILITIES

WHAT YOU SUBMITTED SHOULD BE OK.

I am thinking you do have a service connected condition rated and it is keeping you form finding EMPLOYMENT and meets the guidelines from the VA..???

IF YOU HAVE DID ALL OF THIS?

  NOW YOU JUST HAVE TO WAIT FOR A DECISION..

IN THE MEAN TIME I WOULD SUGGEST YOU REQUEST TO GET IN  VA VOC-REHAB, IF THEY CAN'T FIND YOU ANY WORK YOU CAN DO   THEN THE COUNSELOR WILL WRITE YOU A LETTER DETAILING YOUR DISABILITY OR SAY  IT IS UNFEASIBLE TO RETRAIN THIS VETERAN AT THIS TIME DUE TO HIS  S.C. DISABILITY.

I filed the end of February and having been gathering medical information since I was awarded the 70%. 

I have my c and p exam. The termination letter which specifically states i am unable to perform my job due to a failed fitness for duty. I have the fitness for duty and excerpts from that doctor that said i have issues with co workers and continue to have issues with my bipolar. My doc wrote a letter stating i am unable to handle any type of stress. I am getting a friend to write a letter. 

The only piece i am missing is the box rehab but i will start working on that whwn i get back from my emergency vacation.

No need to be worried about drawing unemployment, it is one of those programs that you pay into just like Social Security.  Your employers pay into this program also.  There are a lot of veterans that draw both SSDI and VA disability.

Not exactly.  For at least "my state" (unless this has changed) when you send in your unemployment form, you sign that you are "ready, willing, and ABLE" to work.  

Now thats in conflict with tdiu which says you are "unable" to maintain SGE due to sc conditions.  

You cant be both "able" to work, and "unable" at the same time.  

But, dont take my word for it, as my information is dated and may not be accurate.    LOOK it up on your state's unemployment website as to their qualifications/criteria for unemployment.  Again, if your state requires you be "able" to work, then that contradcits tdiu, which says you are "unable".  

Now, many people go through a transition period and they simply dont know if they are "able" to work or not.  But...read what your doctor says.  Your doctor should decide if you are able or not.  

Remember, VA TDIU says you cant do "any" job, not just YOUR present job.  In other words, if you break your knee, and cant pick up and carry boxes anymore, you "may" be retrained as a computer programmer, for example, where you dont have to carry boxes.  

ITs my "opinion" that VA wont make your tdiu "effective" until you are no longer receiving unemployment for reasons I stated above.  

Just be honest, and let your evidence speak for itself...your opinion and my opinion does not matter that much, probably neither one of us have a medical degree, nor do we have training in Vocational rehabilitation.

I contacted voc rehab today. I will let them make a decision if i am unemployable. If so i can stop collecting unemployment because i would not be able to work.

My effective date is Feb with 70%. My unemployment runs out April 1. So a lot sooner then the decision of tdiu. I am not sure how long it takes voc rehab to do their thing.

I was awarded TDIU while I was collecting Unemployment for termination. I had a Vocational Rehab Specialist also put on paper that I cannot maintain employment due to SC.
