There will be mixed reactions at RO's for what they do. But I think it is safe to say that if you already had your claim in and your doc provided a dbq, since it is already in the pipeline they are going to consider. The mere fact that the dbq's are no longer available on line will really reduce those be submitted in the future.

Be forewarned that even though this C & P examiner stated/noted that you have a private DBQ in your records, the rating specialist may not accept your private DBQ.  The problem with the DBQs were veterans were getting them from out of state physicians where it was not an in-person exam. In-person DBQs should be accepted but VA may challenge out of state non in person DBQs. I would even think an out of state in-person DBQ exam should be accepted by C & P examiners and rating specialist but VA is VA.

I filed new claims on April 30 for the FDC program.  It updated on May 6 saying development letter was sent.  So, I was expecting to get a letter stating that I was excluded from the FDC program because I have an open HLR.  Usually they exclude you form FDC if you have other open claims.  This letter is simply stating that they received my claim and no action was needed at this time and they would order exams if needed.  I already see that a request for an exam was submitted.  I was expecting to get a 5103 notice if they even still send those.  I'm wondering if this is even considered to be a development letter.

What I thought was funny is that they still have information on these letters saying that private doctors can submit DBQs and goes on to provide the link to said DBQs.  Of course, when you go to the link it says that the VA has discontinued the use of public facing DBQs.

You can still have more than one claim going at one time. If they are the same type, they will combine them together, say 2 FDC issued separately. But you can have two or seperate types of claims open at the same time and they aren't combined. Like a FDC and a HLR claim. For instance, you submit a claim with two or more disabilities claimed, some new and some supplemental. They split them off, the two different types. On the supplemental group, you have a claim with an item denied; you submit a HLR against it. You still have two separate claims being worked on. You can also throw in an appeal to BVA; again, a  separate type of claim. As for the letter you received with the dbq link, they just didn't update the template to remove that and they just used it WITHOUT THINKING. So, what else is new.

The MR21-1 must not be updated then.  It's still showing that a claim will be excluded from FDC if you have a legacy appeal, higher level review (HLR), or notice of disagreement (NOD) with the Board of Veterans' Appeals (BVA) pending at the time VA receives the EZ form.  I'm not even sure it the letter I received would be considered a "development" letter.

All of the private DBQ info is still in the letter.  It mentions it a couple of times.  Ha ha!

When the VA pulled the public DBQs, one of the reasons they stated was the publicly facing documents were often out of date with the updated regulations. It makes me wonder if the publicly facing M21-1 might also be out of date...
