Higher Level Review Timeline

Question

Received this today from the congress liaison for my higher level review case. Today is day 88 and it the website says the HLR review shouldn't exceed 125 days. Does this email mean that it'll be done within days, or is this just a generic email? Also, what is your opinion/outcome on HLRs, if you've had one or dealt with one. Thanks.

FlyboyLeRoy Th HLR 125 days estimate is a goal, not actually what they estimate your claim will be completed. Good news though; the numbers they are reporting say they are now beating the 125 days. Find something to do for a while. I hear fishing is good. :>)

The VA actually has "no time limit" to complete your claim.  Sometimes, even Veterans or their representatives, delay the claim by:

1.  Filing it on the wrong form.  

2.  Submitting new evidence with a HLR.  If you want to submit new evidence you should appeal to the BVA or use a SCL appeal.  

3.  Sending it to the wrong address.  

4.  Forgetting to sign it, or other wise failing to  complete the forms carefully, omitting important information.  

5.  Sometimes the Va sends letters to the veteran requesting additional information, and it can result in a delay or denial if you fail to send them the required information.  

6.  Failure on the part of the Veteran to attend a c and p exam, if requested by VA, can also result in delay or denial.  Occassionally, the Veteran doesnt even know that a c and p exam was scheduled, until the Veteran gets a denial letter.  

     Does the claim show up in ebenefits?  You also may have received a letter acknowledging the HLR appeal.

it does show up in ebenefits and i've also received the acknowledgement too. No new evidence was submitted with the new claim and the initial claim had all of the required paperwork as needed by the cfr. Hoping to hear something soon, since it should have been an easy open and closed case with all nexus/dqbs/etc being favorable. Thanks for the input.

That's good to hear. At about 70 day time frame is when they sent it off to a different regional office and now it's pending to be viewed by a vsro.
