VA disability compensation rates listed below are for calculating your retroactive pay once you win your claim. For example, if you were awarded 50% from 1997 to present you will be paid at the 50% rate for the corresponding years.

VA Disability Compensation – The VA disability compensation benefit evaluates disability resulting from all types of diseases and injuries encountered as a result of military service. The degrees of disability that are determined by VA represent, as far as can practicably be determined, the average loss in wages resulting from such diseases and injuries and their complications in civil occupations. Generally, the degrees of disability specified are also designed to compensate for considerable loss of working time from exacerbation or illnesses. Source of Data: Veterans Affairs Compensation and Pension Benefits Website

You may wonder how does the VA decide if I’m 70% or 30% well there are many reasons but let’s start with the basics and move on from there.

First, your disability is listed in the law 38CFR4 Schedule for Rating Disabilities this document is dry reading, read it anyway. It will list your disability/diagnosis and it will tell you what symptoms equal what percentage. Now the compensation and pension exam doctor will examine you and make notes indicating your disability and your limitations then a VA rater will look at the doctor’s results, look at the evidence, look at your claim (contentions) and look at the law and then make a decision. So the moral of the story spending some time looking at 38CFR4 Schedule for Rating Disabilities

 

While I’m here also check out the side effects of any medications you are on for your service-connected condition. Those can be claimed as secondary to your service-connected disability. You are your best advocate.

My problem is  my Bank only goes back to 2009 , although I was awarded a 50% rating in 2000, ..and A 40% Increase in 2003 COMBINED RATING AT 90% and was inferred the TDIU  P&T May 7th 2003

I first filed my claim in 1998  and when I was awared the IU P&T but never realized I never received the back pay for EED however I did recieve about 9.750.00 

I ask my Bank *same Bank from back then direct deposit ect,,,ect,,

if they can give me a Historic Payment count back to2000/and 2003  so I can check that retro payment ?   they only can go back to a certain year  as the VA only goes back to 2009...thats what is in e benefits.NO FURTHER BACK THAN 2009

we remember it was close to the 9,750.00   but looking back on this that seems way short.....broncovet and I are working on this  as soon as I get settled from moving and can get a va claims agent in my area to look into the VBMS  because my C-FILE IS MISSING A LOT OF RECORDS.

ITS A MESS.

Buck Just spitballing; you could call your state "Banking" Commissioner's Office and ask them what options you have to get the bank to provide your baking records. You could also check the same with the IRS. Problem is that computer records in the 1980's sometimes were "filed' and they destroyed them later. Laws on that changed and they probably have to keep those now forever, but back then, maybe not.

Buck, you can request a copy of your payment history from VA. You can request a copy of all your complete rating decisions including the legacy pages (NOT YOUR C-FILE).  You can scan your CD C-file and review all your payments breakdown. I am not sure but you can contact your bank and ask them how long do they keep their microfiche deposit records (They may only go back 10 years). You can also request VA to do an audit of your account. This will take some time and I am not sure if VA would be willing to do this easily.

While this was posted in 2020, its still revelant today.. and just look at those rates, in 1974, 100% was $584, when I got my TDIU in 1999 it was $2036... then I look at todays rates, and my opinion is verified,  VA compensation still lags behind the actual lost earning power of most vets....  Its hard for most vets to live on todays rate, image how much worse it was back in 1974... I would like to see rates back to 1954, not that would be real interesting . Thanks for the infor Tbird.
