Good afternoon to every one, my question as follows after c@p exam completed how much long will it be to get answer will it take to get up or down? Does it usually take 6 months to get 100 percent temp disability for surgery? I had back surgery back in July and I am still waiting, yes it is service connected,

      I was awarded 100% PT for several issues about a year ago. My code sheet (from my FOIA request and confirmed verbally by my VSO, and then by a VA phone rep) indicates that everything rating is 'static' except for my back issue(40%) and radiculopothy for both legs (20% each). Those two items are listed with a re eval scheduled for about 8 mos from now. I am confused how I am P&T but still having to do a Re eval. To make things more confusing I am 100% static for mental health stuff. Even if the reduced my back I would still be 100% for MH stuff alone. 
      Any thoughts?

      Well I am at the court pro se lawyers all did see thing my way so I no my case best 25 year of fighting.
      Well I got the case expidate at the bva an the veteran court. Myself
      Now the chairman is fighting the court review of the chairman reconsideration.
      Here my case in nut shell granted tdiu 60 one condition 2001. Find out at board that my appeal from 1993 had never been cretifed to  board.
      Great tdiu should now be 1993 no court let va stage rate me 40 1993_2001 well I was granted extra schedule tdiu never worked 1993_ untill 2001 granted.
      Never look at for housebound smc s
      Well my condition got worst my ex left me my doctor put in for home care 3 years ago I get 3 days a week smh
      I apply for smc benfits an va when crazy lol
      Smc s should have been referred I have never left my house in 25 year to make income. Smc s housebound one condition.
      I apply for smc r they granted me smc l never stated I get in home care an vha pay for it even have the va doctor report stating with out in home care I will need nursing home services grants u smc r2 never done.
      Change my tdiu 25 year protect rating. To granted two months of smc s lol never address the 25 year history
      I do the bva reconsideration they tell me I have to reapply for each smc r r 2 an o benefits. Really put this on the decision.
      Told me all my condition are included in smc l lol.
      An it was ok to change a 25 year protect rating to granted smc s  2 month.
      I get to court they don't included my reconsideration or the chairman decision.
      So I press the Court they order them to explain why these things aren't included in record to court.
      They state if the bva didn't adjudicated the smc claims r r2 this is not an error An the chairman didn't error. Because I can appeal the bva decision to court
       I should only be able to do is appeal the bva decision not the reconsideration.
      They lose smc is based off record an u don't have to apply for each one
      The chairman told me I have to reapply for each smc on the decision
      Which if I had u loss my rights to court review see there trick lol.
      Well now I am waiting for the court to rule on this.
      I really just need to vent this is a new fight I play this game back in 2002.
      I got granted my tdiu 1994-2001 I let it go. Now I need help it's a battle again. Because of there mistake again they owe me an here I am at the Court again smh

      My sister recently had a C&P exam done and this morning she logged in and it said that notice for request 5 closed, does anyone happen to know what that means. I've googled and looked on several other boards but I can't find anything that speaks of request 5

      Good morning received letter from VA I was denied my claim for cervical fusion. First I am at 20 percent Lumbar degenerative disc disease, and 10 percent for each leg Radiculopathy. I was a crew chief on CH46 helicopter with about 2000 hrs of flying and at least 500 hrs on Nvg's I has denied no service connection, even when I supplied case studies from the Army and Navy on neck pain and shoulder pain from wearing NVGs for period of time. Second I prouder two letters from two different doctors that my current problem is due to military life.  C@P exam lasted only 15 mins and that person said I could not fine any complains in military medical records, of course not If I went to sick call for pain I would get pills, a down chit would not be allow to fly, I would have lost pay, and be assign to other duties.  My first case with Lumbar went all the way to BVA.  So any ideas what I should do? Any thoughts on Lawyers? I appreciate all inputs.  Thanks Ken

      Can i walk into the VA Regional Office to get a copy of my C&P exam on the spot? . They do not have them at the VAMC because they were done with QTC.

    • Post in New BVA Grants
      While the BVA has some discretion here, often they "chop up claims".  For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.  

      I hate that its that way.  The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel.  
    • Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!

      My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.

      Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!

    • I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even  reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it. Just about twenty question, and  nothing about stressor,
    • This is the latest Compensation & Pension (C&P) Clinicians Guide dated 20180719. The only other one I've seen is dated 2002, including the one on this website and the VA website. I got this from my claims agent, who got it from the VA.
