VA claims denied 1 day after my C&p exam

So I filed for disability about 3 months ago and just had my exam on Wednesday for back and stomach. 

 

I injured my lower back a few times while in but feel I never got proper treatment. After I got out I've injured my lower back continuously. I finally had an MRI done and they found a tumor. 

 

I had surgery and everything a year ago, the surgeon told me there is no guarantee this is what is causing you back pain. Been a year and half since surgery and still having problems. 

 

So I filed a claim I didn't mention tumor but brought it up during my cp exam and explained everything. The examiner made it seem like I certainly had a case for my back as they could see my injuries while I was in. 

 

I guess my point is I'm confused in how I had my exam on Wednesday and all of my cases were closed and deemed not service connected. Can the examiner relay that information that quick to be denied one day later after sounding like it was certain I would receive something

I think you need to have the surgeon write that up.    Using the "likely as not" nomenclature to describe what he writes up.  Try to put your frustration into figuring this crap out.

Ducato90 Welcome to Hadit. The best thing to do is to issue a supplemental claim. The examiner may have "sounded like he was sympathetic," but you need to get a copy of what he actually wrote up. Request a copy of the C&P exam. You are not qualified to diagnose your medical opinion and if it is service connected; you need a medical opinion, IMO from a specialist to do that. Without it, appealing the denial will be a waste of time. You're not likely to get that kind of eval from a VA doc, so start researching getting a doc to do the medical opinion.

I guess I'm just upset at the fact I had injuries while I was in I know this. But I'm just surprised that literally one day after my exam my case was closed and denied. I filed for depression and anxiety as well and didn't even get an exam they just denied everything. I understand what your saying. Thank you for the response

I would be really surprised if they could get the information that quickly and make the decision.

Did these show up during service? I got depression secondary to chronic neck and back pain. My civilian doctor at the time wrote he thought it was coming from my pain. You can take these up with your current doctor and see what they say.

      Thanks,  All The Way. I was rated at 30% after the temp 100%. My range of motion and flexion is no problem. There's just a constant pain that is kicking my but and none of the meds relieves it. My Orthopedic Dr is very good, but I can't seem to get the C&P examiners to understand about the pain. Revision maybe my only option, I just wanted to know if the VA pays the temp 100% after the revision surgery. Is there a reg that covers revision surgery?  Thanks for all your help.

      What is the VA process as far as pay for revision surgery. After surgery two years ago I was rated at 100% for a year. I'm having problems with my TKR and the Dr may have to revisit. If he has to replace some of all of the knee do you receive 100% temp again?z

      I recently had a supplemental claim submitted by the law firm that representing me on the 5th of October and it was closed on the 5th because page 2 wasn't sent over. I informed them and they resubmitted everything on the 9th and they verified that all the pages were sent over, but when I checked the claim today it still says closed on the 5th of October. I wanted to know is there a set time that they have to reopen the case because it's going on 3 weeks since they have had  the info that they need to reopen it.

      How do I proceed on filling a new claim for hip replacement(s)?
      Retired in 2010 BENEFIT SOUGHT:
          Background - NEW - Service connection for chronic bilateral primary osteoarthritis of hip with a complex labrum tear (Right side).
      Was diagnosed with chronic bilateral primary osteoarthritis of hip with a complex labrum tear (right side, with moderate right and severe left degenerative changes of the hip. Evidenced by bony proliferative changes and subchondral sclerosis. Right, lateral, femoral head neck junction subcortical cyst, 8 mm in size (Radiology Reports). Served 24 years and 1 month(DD Form 214)in my military occupational specialty as a Postal Specialist(8M00). The DoD 4525.6-M list the physical qualification to be selected and maintained into this occupational specialty.C5.3.2.7. state that the personal cannot have permanent physical restrictions prohibiting duty involving prolonged standing, walking, or lifting of weights up to 70 pounds (DOD 4525.6-M Extract). Due to the nature of my job, daily significant physical stress was placed upon my body staining my lower extremities.                  -Loading and unloading 20/40 foot mail trailers(bending, lifting, and            stacking)containing  mail pouches boxes as well as loose items without a conveyor belt.
                      - Loading and unloading (bending, lifting, and stacking)commercial air craft cargo containers.
      Radiology Reports Starting in Nov 2015 - Sept 2018 - Shows a advance degeneration of the hip(s). Nov 2017 - MRI was performed , found complex tear of the anterosuperior labrum Dec 2017 - Hip Injection of Steroid. Treatments (Prior to hip replacement) Physical Therarpy Medications (Anti-Inflammatory, pain) Steroid Injection Total Hip Replacement was done  in Oct 2018 and Jan 2019. A NEW - Service connection for chronic bilateral primary osteoarthritis of hip with a complex labrum tear (Right side) WAS NOT done due to the fact that I had the THR(s) done prior to obtaining all the documents needed to be filled. I do not have any thing listed on my VA Physical Examination on the Labrum tear and or  for degenerative hip(s).  I was only checked for ROM in the joints, no X-rays were done, other than for Lumbar tendonitist (which was not granted)  Can I make a NEW CLAIM for the HIP Replacement(s)

    • Post in New BVA Grants
      While the BVA has some discretion here, often they "chop up claims".  For example, BVA will order SERVICE CONNECTION, and leave it up to the VARO the disability percent and effective date.  

      I hate that its that way.  The board should "render a decision", to include service connection, disability percentage AND effective date, so we dont have to appeal "each" of those issues over then next 15 years on a hamster wheel.  
    • Finally heard back that I received my 100% Overall rating and a 100% PTSD rating Following my long appeal process!

      My question is this, given the fact that my appeal was on the advanced docket and is an “Expedited” appeal, what happens now and how long(ish) is the process from here on out with retro and so forth? I’ve read a million things but nothing with an expedited appeal status.

      Anyone deal with this situation before? My jump is from 50 to 100 over the course of 2 years if that helps some. I only am asking because as happy as I am, I would be much happier to pay some of these bills off!

    • I told reviewer that I had a bad C&P, and that all I wanted was a fair shake, and she even said, that was what she was all ready viewed for herself. The first C&P don't even  reflect my Treatment in the VA PTSD clinic. In my new C&P I was only asked about symptoms, seeing shit, rituals, nightmares, paying bills and about childhood, but didn't ask about details of it. Just about twenty question, and  nothing about stressor,
    • This is the latest Compensation & Pension (C&P) Clinicians Guide dated 20180719. The only other one I've seen is dated 2002, including the one on this website and the VA website. I got this from my claims agent, who got it from the VA.
