I Think The Va Screwed Up Bad

Question

I put together a couple of charts using a data base program to help me at my hearing. One has every piece of evidence submitted, date submitted, what the evidence is, who submitted it etc etc etc . The other chart is all the conditions and diseases and dates of actions. Look at this and tell me if something doesnt stick out real bad and is a big booboo I think in procedures.

I am filling out form 9's because my year is up and I havnt even got s SOC in response to the NODS I filed?

i dont know to me its tooooooo much info , i would say for a person with all this stuff wrong how did you find the time or the brain power to do this work... i sure would not give IU ,,, your more organized then an accountant... And raters are always suspious of everyone anyway it looks to me like your playing the numbers ,, file 20 claims and see which ones slip thru... your report makes me think of what a lawyer told me one time..... One time i installed a shower door in a women's apartment she claimed it fell off the tracks and scared her so much she was not able to work anymore and was suing ,,, me , the people who sold me the door, the people who make the glass , people who made the screw to intall the door , the tool compay who made the tool i used to install the door the apartment manager , assit, manager , owner of the apt. property management company , and the company who build the apartment 14 years earlier... almost all of them people settled for something because it was easier then hiring a lawyer, even i had to kick in 1000 dollars the property owner gave 29,000 and so on and so on.. this was her 7th lawsuit of this type and she was only 23 years old.. She was playing the numbers and it left a very bad taste in my mouth to be ripped off by such a scam... I say be real be yourself accept your messed up and dont hide it by being so organized , with my PTSD sometimes i wake up fast and cant remember where i am or what year it is for the first few min...i do hope you have sucess with everything you seek..

Robert51 makes a good point. Myself... when I read your chart I thought man this guy should be dead.

But really, how long after you left service before you applied for service connection for all the problems you listed? Did you have medical evidence and doctor statements supporting the claims?

Can't tell if anything sticks out in the way of va error, because we don't know what the va denials said, nor do we really know what your NOD's have said.

I see nothing wrong with being organized or filing multiple claims provided they are backed with some evidence. I won at the BVA a weak minor claim ( 0%) that later proved to very important. My stronger evidenced major claims were and still remain denied. Naturally, I am appealing with an attorney.

So, ya never know what will be granted.

Incidentially, I recently had a MRI of my right shoulder done at the VAMC, naturally the report came back identifying it as my left shoulder. Took all day to get it straightened out. My two neuropsych reports were inconclusive and notable for being almost devoid of accuracy. Pages and pages of baloney that said nothing concrete...only maybe this or maybe that despite that my EMG showed bifrontal intermittent slow rhythm...my CT scan showed mild frontal atrophy...however, my MRI showed no abnormality?? Of course, the VA's MRI machine is almost an antique...lowest tesla in the area.

Rickb54 is correct, it's hard to tell because we don't have your C-file in front of us to see what's what. Also you do not need to fill out VA Form 9 until you receive a Statement of the Case (SOC). The one year time frame you refer to is the time limit on submitting a NOD after receiving a rating decision. It doesn't matter if the VA takes 100 years to issue a SOC, as long as you filed your NOD in a timely manner, your appeal(s) is/are still alive. Once you do receive a SOC, then you only have 60 days from the the date of that SOC to send in VA Form 9 or "new" evidence. I think you jumping the gun here.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
