I Think The Va Screwed Up Bad

Question

I put together a couple of charts using a data base program to help me at my hearing. One has every piece of evidence submitted, date submitted, what the evidence is, who submitted it etc etc etc . The other chart is all the conditions and diseases and dates of actions. Look at this and tell me if something doesnt stick out real bad and is a big booboo I think in procedures.

I dont know who Vike 17 is, I suspect he is a VA employee or former VA employee he seems to know what he is talking about and gives good advice on this forum.

Vike 17 wrote "you do not need to fill out VA Form 9 until you receive a Statement of the Case (SOC). The one year time frame you refer to is the time limit on submitting a NOD after receiving a rating decision. It doesn't matter if the VA takes 100 years to issue a SOC, as long as you filed your NOD in a timely manner, your appeal(s) is/are still alive. Once you do receive a SOC, then you only have 60 days from the the date of that SOC to send in VA Form 9 or "new" evidence. I think you jumping the gun here."

All I know is this is from a award letter and every award letter I have says the same thing. They dont say anything about socs or anything else just the fact you have one year from the date of this letter to appeal the decision. Thats what I am going on.

Send in the new evidence or the Form 9 if you got the SOC. You don't want to fool around and argue while yout time is running down. You can ask for a DRO Hearing on the Form 9, and then if that fails you can still go to the BVA. If you have evidence send it in and if not file the Form 9. Nothing much is going to happen until you file the Form 9 anyway.This is the kind of regulation you want to conform to because it is easy for the VA to blow you away if you go over time lines. A date is a date and is not opinion or benefit of doubt. Be very sure you can prove you submitted the Form 9.

John thats pretty much what I am doing. I put the following statement on the from 9. "I have not received a SOC on the issues contained on this form 9 even though I have filed a NOD on 3/6/06. I take exception to and preserve for appeal all errors the VARO may have made or the Board hereafter might/could make in deciding this appeal. This includes all legal errors, all factual errors, failure to follow M21-1, all due process errors and any failures to discharge the duty to assist as violation VA laws and regulations within 38USCS and 38 CFR.

I then attach a statement in support which states

" I am the above named veteran. Please be advised that I am submitting my form 9 to protect my right to appeal those issues listed. I do not want this VA Form 9 to supercede my request for a hearing with a DRO which is currently pending."

I think I am covering my rearside very well :D After they receive this they will have everything I am also sending a VCAA Notice. Maybe I can get my hearing finally scheduled and wrap all this BS up :huh:

That is a long time to have to wait for a SOC. I think you are wise to file the Form 9.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
