70 Percent TDIU Permanent

I am currently 70% TDIU (since February of 2016).  Apparently the VA changed me to a Permanent status (am eligible for CH. 35, ChampVA, and dental through the VA), I was never sent anything saying Permanent and Total or eligible for Ch 35 etc.  I found out last month when I went to get plates for my new vehicle and they contacted the county veteran's office who told them I was permanent (saying nothing but total).  I talked to the county veterans office and they had me fill out an app for Champ VA because they saw in the VA's systems that no further exams are required and they wern't sure if it was P&T or just permanent.  Ebenefits letter says not permanent and totally disable.  Today I received a letter from the VA with my benefits and ratings and where it would say about being Permanent and Totally Disabled it says "Are you considered to be permamentally disabled due to your service connected disabilities:  Yes at 70%.

So I have established ChampVA/CH 35, dental etc eligibility.

But does that mean I am P&T?  DO I qualify for ID card, space A travel etc? 

If not P&T from my understanding the VA doesn't have just a permanent its either P&T or not, and also wouldn't be eligible for ChampVA, dental, or ch 35. 

 

Any help is appreciated.

You are welcome.  VA decisions rarely state "permanent and total".  They use other phrases which MEAN P and T to VA, but not necessarily the rest of the world:

1.  Eligiblity to chapter 35 benefits is established.  

2.  No future exams are scheduled.  

     Both number 1 and number 2 are code words for "p and T".  This is rather frustrating for Vets.  Try taking a letter from VA that says, "no future exams are scheduled" and try to convince your local county tax assessor this means P and T, and VA does not come right out and say it.  

    This said, if you go to letters in ebenefits, or VA.gov, you should be able to print a letter that says you are p and t "if" your decision reads either number 1 or 2, above.  

     Its the one part of ebenefits that is accurate.   You wont be able to print a letter that says you are 100 percent P and T, unless you are.  It may not be up to date, but VA does not want Vets running around with letters saying they are P and T, when they are not.  

     The reverse, however, is not necessarily true.  Just because ebenefits does not have "letters" updated, does not necessarily mean you are not P and T.  Especially when first awarded 100 percent p and t, it may take a while for you to be able to print a letter stating same, because ebeneifts may or may not be updated.
