Va asking for more time to response to my petition

I am so pissed 

I just had to oppose the va request for more time to respond to my petition.

The court gave them 30 day now the lawyer is asking for more time to get a response from bva and ro about my cavc remand.

If it was in the va system still as a cavc remand they shouldn't have a issue address them.

I just oppose them asking for 15 days lets see what the court say.

Crazy part I was just told there was a admin strive error made by put my effective dates under a new docket under ama.

But they still haven't send them back to the judge tho.

This is a crazy process this time for real.

Pursuant to United States Court of Veterans Appeals Rule 26(b), 
Respondent respectfully moves this Court for a 15-day extension of time in which 
to file the Secretary’s response to the Court’s July 13, 2021, order to respond to 
Petitioner’s petition for extraordinary relief in the nature of a writ of mandamus, 
which would otherwise be due on August 12, 2021. 
The request for additional time is being made to allow undersigned counsel 
additional time to coordinate with the Veterans Benefits Administration (VBA) and 
the Board of Veterans’ Appeals (BVA) regarding the status of Petitioner’s claims. 
Appellant is proceeding pro se in this matter and has not been contacted 
for his position on this motion.
WHEREFORE, Respondent respectfully moves the Court for a 15-day
extension of time, until August 27, 2021, in which to file his response

 

I guess this is a good thing to because it mean. They are try to come up with something.I 

I am not all over the place. It's the games I am fighting

I was relaxing not think about this stuff now I am back at it smh.

The fight continues lol

Well, time extensions are routinely given.  You will probably spend more time than 15 days opposing the extension, and alienate your adversary.  

Fight em on the important things, give in on the little things.  Make them feel like they "won".  You dont need to have them tarred and feathered.  While I dont like delays either, opposing the time extension may mean it takes longer in the long run.

The more time I give them the more crazy decision I get.

I have always oppose give them more time at the Court in my case pro se

Now will a lawyer oppose it in case at the court no.

It a gentleman thing. I ain't a gentleman lol  or part of there club.

Do they give us veterans more days if we miss put something in no.

So no I don't want to wait and I hope the court don't allow it

Well the court granted them till August 25 to answer the petition.

I feel they we're going to grant the additional time.

I spoke with lawyer for va he explain he got get a declaration from bva and va. Explain what they have done or are doing with things remand by the court.

So I guess I am happy someone will have to look at what is been done.

My hope is to get the court to make the bva and va give updates as they process the cavc remand. If the court see there errors.

I just want to get all my issue remand by the court

Return to the board in the front of the line like it is to be by law.

And get this bull from qtc put in the system so my remand for loss of use can be return to the board.

I will be happy I refuse to wait years for something that was remand by the court.

Ok I am finish venting lol

Well my mind was on the 25 that the va had to respond it the 27th smh.

More time for my mind to go crazy lol.

I just put in a request to the judge to answer there response.

Yea I am on top of it don't want them to be just stating stuff to court and court rule without my response.

Well let see how all this go this week.

I really must say I thought it would be a fight to get smc under Howell v nicholson bck to 2001.

And the smc r for my in home care.

Never seen the volating of the court order remand coming.

I just hope everything get Address.

The effective dates which were remand by court and we're a 2018 legacy appeal are now in the new appeal system with a July 2021 appeal date now.

Crazy part I never ask for them to be switched I would love to see were I requested this.

The mmd remand is at bva I keep been told I requested a video hearing. I have never requested one.  I never check the box on va form 9. I don't care how many uploaded Iris done by va.

They still have this in system hold up my appeal. 

 

Ppl stay on top of your case and do research on it.

In my 25 years of dealing and researching I never seen nothing like this. Smh 

Ok I am done venting.

Last thing the va really took 6 week to explain to the court we're and what up with a cavc remand.

I think there about to come up with something bogus.
