What form should you use?

After some research, I have decided the VA has a definite answer to this question of "which VA form do I use?":

The VA has no idea which form to use!!!!!!  No clue.  Ask a different employee, get a different answer each time!!  

At least ONE well known Vets advocate says to "use both" and let VA discard whichever one they dont like.  

In this Vet's advocat's (Asknod) own words:

VA "intake specialists" subscribe to the theory of:  "Has it been filed for yet or not?" So, if you have never filed for A&A, to them it's a new claim. Period. The fact that they were supposed to "infer" it as an ancillary claim by law is immaterial. To them, you have not filed for it yet. If you use the 995 supplemental path, they will do a look back for any prior filing for A&A and see nothing. At that point, due to a short between the ears, they will inform you that you have chosen the wrong form to file with and reject it until you send in the 526. I've played this game with them and even had a second letter identical to the first saying the form I used was incorrect and to review the AMA process on VAF 21-0998 to select the right one. At that point, I call up my CMA and ask her to fix it. 

As I pointed out, you can't ever go wrong by filing both forms and letting them play Phonics and sounding it out. 

 

Does anyone else find it incredible that VA is sooooooo messsed up...they dont have a real firm policy of what form to use when submitting an application for benefits?????  Or, they do have a policy, but VA employees are so poorly trained that they have no idea what the rules are for using a particular form.

It’s a very specific form and it’s easily findable by googling aid and attendance form. It’s a 21-2680. You only need an 0995, 0996, or 10182 if you were denied.

I don't think these are miskate.

I seem the va has been changing.

As other have stated favorable evidence not listed. 

I don't think they even read veterans statement anymore.

The bva has no number to contact

The comp exam take months to get than u got to wait months for them to put it in the system.

To be told u need another exam.

I really feel alot of it is to discourage the veterans and hope they miss a date fill out the wrong paper work.

I don't think it much of a veteran friendly system anymore.

These new bva judge's don't follow the law. One of my bva decision sound like a ssi decision.

My thing is it about to get a lot worst. 

It's turn into a money game what was the purpose of give billions to a contract company that has no hospital or doctors.

When va hospital is in ever state and have every specialist to do any exam.

Comp exams take months for every one and have for the last year and a half. There’s nothing we can do about that. OPM controls staffing and whether or not we’re open in the federal side, the contractors are private and control their own staffing. Contractors cost more money than doing exams in house so it’s not VA winning. I’d be more worried about congress people that think it all should be private.

Ok the government va bva congress. What ever way you look at it is try to change the veterans services.

And let private company in.

They are try to get rid of the hospital all together. Community care.

I am a 25 year disabled veteran I love my va hospital care.

I like going to va for comp exam made me feel more relax.

Veterans are now have comp exam with workman comp ssi doctor.

Who don't understand how the va system works.

 

Veterans are get more reduction after exam.

So yes it s win for va system

If they don't do community care, there are complaints about wait times or quality of care. If they do community care, there are complaints about privatization. If they do only VAMC exams there are complaints of favoritism for the VA and/or conflict of interest, and wait times. If they do contractor exams there are complaints of privatization, favoritism, whatever. 

?

IMHO (IN MY HUMBLE OPINION, due to the what is the correct form to file and when to file the correct form, more and more veterans have to file an appeal and even with the new application veteran claims are being returned/rejected not denied and saying that the veteran filled out the wrong form and when the veteran fills out the form that the VA request, the veteran is then given a denied claim because the veteran filled out the wrong form and have to file one of the new appeal forms. The VA can see what the veteran is claiming but offer no assistance in helping the veteran complete the proper form. As stated above, the VA still fail or ignore the veteran’s evidence. Once the veteran files a claim, what happened to the duty to assist. It appears that the simplest way to cause more confusion is to deny the veteran’s claim without proper duty to assist.
