SMC-O or R2?

Rate this question

Question

Good Afternoon,

Could you please direct me in the following. I have 2 A&As that the VA grouped together under A&A. My wife is a physician that takes care of me for PTSD keeping me safe from hurting myself/others (also states that I am in danger of hurting myself/other in my psych evaluation from VA that awarded me 100% PTSD Rating and for total loss of both feet and spinal issues where my wife injects me daily, provides physical therapy for me and changes and addresses my wound care, not to mention all Acts of Daily Living. So, my question is do I file for a higher level of increase for SMC O because of 2 A&As (Or even on A&A and Loss of use SMC-O, or do I file for a Higher Level of Care based on the additional things only a medical professional can provide? Should I really get a lawyer?

Thank you very much

You sound like you have all the evidence.

I would appeal asking for the o for the two smc l and I would stated for the loss use.

As you stated your wife is a nurse I would include this.

By I would apply as smc r and r2 because your care is provided by a professional. Not a regular person that is the lower smc l.

And if they play about your wife providing care. It's still smc r

Include all her paper proving she is a nurse.

Include the a@a exam you took for smc l and a listed of all exams. This might get you by without a new exam. I said might lol

Now the bad part.

I did all this I receive in home care provide by a company. I also got regular smc l. They also include all my condition in one. Never even address smc r or 2

It has been 4 years of asking I had to take it to Cavc they remand to be address.

I got three ro denail seen the court remand it and still don't have a bva decision or any decision which address my need of in home care smc r r2  smh

So my opinion is get ready for a fight.

That you will win
