1454th Solider
If you get rated for 100% before you win a BVA grant, will the VA still pay you the back pay even if your rating does not change.
0 Moderator brokensoldier244th Posted September 24, 2021 Moderator Share Posted September 24, 2021 (edited) If the BVA is for something different than the other conditions that got you to 100% I would expect so but they would have to sort out whether the conditions were intertwined or not- IE you filed an increase for stuff already under BVA (which shouldn't happen, by the way- it should result in a letter saying "these are already on appeal....."). ***Edit*** and effective dates (thank for bringing that up, Pacmanx*** I don't work a lot with appeals, though, so there may be better information from one of the other members. 0 Moderator pacmanx1 Posted September 24, 2021 Moderator Share Posted September 24, 2021 Really not sure I understand your question. The VA granted me 100% scheduler and I had a few separate claims on appeal. Once the BVA granted me an EED prior to my 100% rating that meant the VA had to retro pay my EED that was before the VA granted my effective date for my 100% rating
0 Moderator broncovet Posted September 24, 2021 Moderator Share Posted September 24, 2021 YOu get back pay on the increase only. So, if your combined rating does not change, you still can get back pay "if" the effective date is earlier.
