Current Appeal date

Question

Does anyone have any clue what the current date of AMA appeals the board is working?  I know I can find the current legacy date in the appeals metrics, but they don't say anything about AMA.

I am also curious about this too because I submitted an appeal at the beginning of this year. The appeals metrics found at https://www.benefits.va.gov/REPORTS/ama/ are pretty interesting to read

I looked at the most recent report on the tab labeled "Part 2 A-H" to find that as of 9/30/2021 the number of appeals pending at BVA is 91,794 with an average number of days being 1,042.8. That calculates out to be about 2 years 11 months. I have read where other veterans appeals have been completed faster, but on the same tab/page it does show the number of staff working on them at each RO and not all of them are working as efficiently as others.

Like most of VA it is a bunch of double talk. If you go to VA.gov it will says something like,

Quote

The Board of Veterans’ Appeals reviews cases in the order they’re received. When you requested a Direct Review appeal in (Month year), your appeal was added to the Direct Review docket, securing your spot in line.

Check back next month for more information on where your appeal is in line and how long until a judge is ready for your appeal.

so you will have to try to get a hold of the BVA. The web site says it Takes about a year (365) or more than one year but who really knows.

The Direct Review option will take about one year for the Board to complete.

The evidence submission option will take more than one year for the Board to complete.

The hearing request option will take more than one year for the Board to complete.

It’s frustrating for sure.  I finally gave up and called the White House hotline.
i searched the BVA decisions, which are out up through august, and at least 30-40 decisions have been rendered just for the same exact date of submission as mine.  The wonderful people at the call center can’t even figure out where my hearing transcripts are.

The BVA posts its metrics on processing in the above link. They separate the legacy from the mission act/new appeals and give dates how long it takes to process. It is not very reliable because this says they should have finished my appeal last April.

@pacmanx1I agree. I chose the hearing option. The VA had numerous chances to read the evidence and apply the law properly. After repeated errors, I wanted to interactively discuss the issue instead of trusting them screw it up again.

@pwrslmThank you very much for that link! It says 444 days for hearings. I went to https://www.timeanddate.com/date/dateadd.html and added 444 days to the date my BVA appeal was received and it looks like April 2022 or so for me.

Funny I have been using this same site to try to figure out what the heck is going on.

I will admit that I really don’t understand this metrics and the only thing I can gather from it is that there are two groups to compare the time frames. The legacy claim has two separate dockets,  Examples: Original Legacy Appeals from certification takes between 810-983 days to process. Returned Legacy Remands from returned receipt takes between 127-256 days. The AMA has three separated dockets, The Direct Review Docket takes between 241-286 days, The Evidence Docket takes between 264-343 days,  and finally The Hearing Docket takes between 444-457 days whichever comes first, and these docket days do not include court remands and advance on the docket claims. If I am wrong or off can someone, please help me out. Even with all this the days keep switching. What ever happened to the BVA stating that AMA Direct Reviews would be completed in less than a year? Not counting holidays and weekends these days can take longer than a year’s time.
