100% p&t exam

Question

Starting a new thread to avoid confusion.  I was awarded 100% p&t on 12/1/2020, effective 7/7/2020 (date of last c&p).  However, in the decision letter it says they are scheduling exams to evaluate my current severity.   What is the point if I’m already 100% p&t. Are they just looking to take away what they just gave me?

Why are they asking for a exam for a condition grant a year ago.

Mr.Cue, even though the BVA granted the veterans claim, and the VA recently granted the veteran 100% P & T, all the claims that were granted were not rated hence the examinations. The VA is not trying to reexamine what was rated they are focusing on the granted claims that were not rated.

That's new.

No this is not new, as stated these are separate grants, one from the BVA and one from the regional office. The BVA grants claims but they do not assign rating decision unless the regional office low balls/screw up effective date and the claim is returned to the BVA for a corrected rating/effective date. This is what we call the hamster wheel back and forth form the BVA to the regional office and sometimes back to the BVA.

I have been on this wheel where the BVA granted my direct service-connection, but the regional office low balled my rating, and my claim went back to the BVA and when the BVA corrected it and my claim was returned to the regional office where they screwed up my effective date and my claim went back to the BVA where they granted me a 1998 effective date. This hamster wheel has been going on for decades and it is a game the regional office plays hoping that veterans would just give up and accepts what the VA gives them.

stops a little short

"We have assigned a noncompensable evaluation for your psoriatic arthritis of the left shoulder"

Why would this be addressed by the VBA on remand? The appeal granted a 0% rating on it. There is no remand to rate this issue. The board granted a 20% rating from 07/20 already. Nobody is going to change that.

Let’s stop talking apples and oranges, you are focused on why the VA would have to address the veteran recently granted/rated left shoulder but failed to realize that the veteran was also granted twelve (12) other service connections that have not been rated. Even though the veteran was recently granted/rated 100% P & T, to complete the BVA decision the other twelve (12) issues that were granted also need to be rated. The VA could just rate these issues but most likely will request new C & P exams to make sure they do not overpay the veteran.
