Why is VA Scheduling a CP Exam for a 20 year old NOD

Question

Good evening. 

2003 submitted a claim, majority Environmental Hazard conditions - Southwest Asia 

2 out of 10 were granted. The rest denied. Submitted an NOD

A few weeks ago I received a letter from VA. They acknowledged receiving my NOD 20 years ago and also acknowledged that no further action was taken on their part on my legacy appeal. 

Basically they let the ball drop on my other claims.

Today I received a call from Veterans Evaluation Services to schedule an appointment for the remaining unadjudicated claims. 

I am grateful they have finally acknowledge my claim, just wondering what should I expect after 20 years?

Best way to manage C&P exam?

Has experienced this before and can share sage advice.  Thank you.

It appears that for whatever reason the VA has decided to process your 2003 NOD. I won a 1998 EED (Earlier Effective Date) because the VA found that I filed a NOD in 1998 that was never processed. With your current 90% rating these separate ratings or increased ratings could push your combined rating to 100% scheduler.

Hi pacmanX1, was it automatic or did you have to take another C&P exam?

C & P exam. Your new C & P exam(s) are to determine your current level of disability in these ratings. Keep in mind that if awarded, the VA is going to have to retro you from 2003 to present and the retro can add up really fast. The rating could be a Fenderson Rating (Staged Rating) where the VA starts you out at a certain rating percentage and increase it over the years or pay you a certain percentage rating for the entire time.

thanks the c&p exams are for old claims denied.  

thankfully, they increased rating for ptsd granted after reviewing the old NOD.

you are right the retro added up really fast.

Yes, I understand, as stated in my first post that for whatever reason the VA has decided to process your NOD. This means that you need new C & P exams to figure out if the VA is going to grant/award your claims that were previously denied.

This mean the 8 issues were appeal and ro never cretifed it to bva.

Which means that remain pending in appeal status. For 20 year smh.

I have a appeal pending like this it was only 8  years pending.

My? Was any of the condition granted in 20 years.

Yes they will try an stage rate you for 20 years.

They stage rated me for the 8 years.

I really never understood the comp exam. For a doctor to tell how disabled you were over those 20 years

But I had one too it help with the 8 years tdiu retro.

 

Because I hadn't work since service.
