Well i have been at peace. The lawyer call me a talk to me about every move on my case.

We talk about law and he address by issues to the court. Can't ask for more.

I don't like that the VA lawyers which are about 5 on 3 cases refuse to address them or do a joint remand.

So I feel this is going always to the judge again.

They refuse to address merging the case together.

To me hoping we mess up. Smh.

Well I am at the waiting stage again.

Telephone conference April 22.

VA brief due April 26

An one case is just getting to were they have to give the lawyer the record.

So next month I should get some type answer.

I hope it works out well for you.  My experience with the VA is:

"Estimate the number of days (or months it will take".  Then take that number and multiply it times 5, and you will be about right.

This is really get real crazy.

So my lawyer calls and say the lawyer is offering to go back a extra year. For the smc l and half.

Ok here is the thing they have me with 3 different case at the court.

Now Fri I have a telephone conference on the mental health.

What are they going to offer to do with this issue.

Man I just can't understand how the court and VA lawyer will not address that there are 3 cases.

Now on one court remand from one year ago.

Well sooner or later someone is going to address this.

Well let's see what the VA lawyer will come up with this Friday during the telephone conference.

Man I just can't believe the way this is working.

Once again the VA lawyer didn't address the issues with my lawyer at the telephone conference.

The lawyer telling me the VA lawyer is clueless.

Man so I will not be get a joint remand on the two case because it the same vs lawyer on both smh.

Now I got to wait for the court to schedule the next telephone conference for the 3 case.

It's a different lawyer let's see how this go. Smh.

I understand this is a big issue but this is really nuts.

Sooner or later someone will have to address my issues.

Ok I understand I said I was going to relax and let the lawyer handle it.

And I am but I still have to vent lol.

Ok so the VA brief on the effective dates for smc s and l is due today.

Still nothing. I will bet a million dollars that they try to ask the court for a extension. Smh 

At the last min to once again drag my case out.

I really feel the va lawyer is going to miss the deadline and I am going to. Have to  fight with my lawyer to press the issue at the court.

I feel helpless now lol I can't do anything but let the lawyer do his thing.

An I hate it lol.

But we will see I am looking a head.

Well here we go again can't say it a good thing or is going to prolong things.

Ok back when I started the appeals to the court pro SE

 I ask for my cases to be consolidate. I was fight 3 different cases at the court at the same time due to the VA errors of handling the cavc remand.

Well after 2-3 months the court order my lawyer to say in 5 days if he want to consolidate the appeals.

Crazy this is why I got the lawyer because they wouldn't rule on the motion.

Now I have no say so about my case.smh I don't feel good about this.

Well I am in the lawyer hands and I feel he just going to put a basic yes we want them consolidate.

But I will wait see what happens.

I am not about to go all into there errors with handling the cavc remand order.

But if the lawyer point the errors out why we have to asking for the case to be consolidate.

An explain each error. My case would get a joint remand so fast.

The VA would have no answer.

 

But now I can do anything on my case and just hope he handle it this way.

This is why I was handling it myself but they were not answering my motions.

Well the fight continues and let hope this is a good thing and the judge is looking at why I have 3 case in front of her at the same time now.

I can't do nothing but .

So yesterday the VA was to have put the record of proceeding in my case.

For the effective dates. So now the VA doesn't have to follow the rule for expidate case under rule 47.

If I or my lawyer miss a date the court would dismiss my case.

I am not call my lawyer I am not saying anything. I will wait and see how the court handle this.

They had 7 days and weekend count from the 26.

I will tell you this I have Never had to fight this hard for someone to look at my case.

Just venting again lol.

The way this looking I got 2 more months before my case will even be in front of the judge. Because of all these moving parts.

An no one will address anything.

I should be have a nother phone conference soon with a new VA lawyer.

So we will see if this VA lawyer will address my case or punt it down the road again

The are already asking for a remand of the smc l and half 2014-2018.

But will not address housebound by fact.

Or smc l for my mental health which give me smc r.

Or that the mental health claim was reopen do to new service records or the effective date by law.

So I sit here without my case been send to the judge because they didn't put the record of proceeding in and the rule is it is to be done in 7 days.

So my case will not be send until they put the rop in my case

An no one cares smh.

But I tell you if a veteran miss one court deadline your case is dismissed.

So why isn't veterans case granted if the VA miss a deadline.

I am learning that the veterans affairs has no recourse for there actions on veterans claims or at the court

So things will never change.
