TDIU question

Question

I haven't worked for 10 years because of my lumbar spine pain and anxiety, I recently received an increase from 60% to 80% due to additional cervical spine deteriation and radiculopathy.  Would I be eligible for TDIU if I haven't worked in such a long time?

Certainly you are "eligible", but "to win it", you will need a doc statement that you are unable to maintain substantial gainful activity due to sc conditions.  

You see, there are many other reasons (other than due to sc conditions) as to why they  are unemployed.  

Some examples:

1.  They dont need the money, so why work, if you dont have to?

2.  They DO need the money, but hate the job, and are looking for something else, perhaps starting their own business.  

3.  They have conditions which are NOT service connected preventing them from work.  

4.  And many other reasons.  The only one that matters is if you can not work due to sc conditions.
